Allegany County man faces charges in Livingston County

INTERSTATE 390 - Sheriff Thomas J. Dougherty reports the arrest of an Allegany County resident on felony charges following a traffic stop.

On July 7th, 2024 at approximately 10:00pm, Deputy Jason Page was assigned to the Sheriff's Office Highway Patrol Unit when he conducted a traffic stop on Interstate 390, in the Town of Avon, for violations of the NYS Vehicle and Traffic law.

The Deputy Sheriff made contact with the operator, who was identified as 31 year-old Jeremy Smith of Grove, NY.

Through further investigation, the Deputy observed what appeared to be a quantity of suspected narcotics in the vehicle. The substance recovered was later alleged to be cocaine.

Smith was arrested and charged with, felony Criminal Possession of a Controlled Substance in the Fourth Degree, and several NYS Vehicle and Traffic Law Violations. Smith was transported and turned over to Central Booking Deputies at the Livingston County Jail for processing. The District Attorney's Office was contacted in regards to bail due to the felony level charges. It was recommended that Smith be released on his own recognizance after arraignment, as the charges do not qualify for bail under the NYS Justice Reform Act. Smith was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Justice Werth. The Judge did release Smith on his own recognizance per the law to return to court at a later date and Deputies did release him from custody.

The Livingston County Public Defender’s Office was present and represented Smith at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified and did appear to represent the People.
