Cattaraugus County District Attorney Report - August 14, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, August 14, 2017:
Arraignments
LEWRENCE R. HENHAWK, 44, of Gowanda, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance, Fifth Degree, Driving While Intoxicated, a class a misdemeanor, Move from Lane Unsafely, and Unlicensed Operator. The incidents occurred on February 5, 2017, in the Town of Perrysburg, when the defendant allegedly knowingly and unlawfully possessed cocaine and said cocaine weighs five hundred milligrams or more. The matter has been adjourned for motions.

MICHAEL J. PUVEL, 52, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Driving While Intoxicated, a class E felony, Aggravated Unlicensed Operation in the First Degree, a class E felony, Use of a Motor Vehicle Without Interlock, an unclassified misdemeanor, Failure to Stop at a Stop Sign, Failure to Yield to an Emergency Vehicle, Improper Turn Without Signal, and Unlawful Possession of Marijuana. The incidents occurred on March 19, 2017, in the City of Salamanca, when the defendant allegedly operated a motor vehicle on a public highway while he was in an intoxicated condition. The matter has been adjourned for motions.
Guilty Pleas
CURTIS C. BONNER,41, of Olean, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony. The incident occurred on November 2, 2016, in the City of Olean, when he attempted to knowingly and unlawfully sell a narcotic drug. Sentencing is scheduled for October 16, 2017.

PAUL S. JOHNSON, 36, of Salamanca, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony.  The incident occurred on November 18, 2016, in the City of Salamanca, when the defendant knowingly and unlawfully possessed a narcotic drug with the intent to sell it.  Sentencing is scheduled for October 16, 2017.

ROBERT C. SIMMONS, 38, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.  The incident occurred on February 16, 2017, in the City of Olean, when he operated a motor vehicle on a public highway while he was in an intoxicated condition. Further, ROBERT C. SIMMONS waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Forgery in the Second Degree, a class E felony. The incident occurred on June 29, 2017, in the City of Olean, when the defendant with the intent to defraud, deceive, or injure another, he falsely, makes, or completes or alters a written instrument which is or he purports to be, or which is calculated to become or to represent if completed. Sentencing is scheduled for October 16, 2017.
Sentence
BOBBI JO CODDINGTON, 40, of Allegany, New York, was sentenced to 5 years Probation for her conviction of Welfare Fraud in the Fourth Degree, a class E felony.  The incident occurred in the City of Olean, when the defendant committed a fraudulent welfare act and thereby took or obtained public assistance benefits; the value of the benefits exceeded $1,000.00; to wit $1774.00. 

FRANK COLE, 34, of Olean, New York, was sentenced to an indeterminate term of 1 ½ to 3 years with the New York State Department of Corrections for his conviction to Attempted Assault in the Second Degree, class E felony.  The incident occurred on November 1, 2016 in the City of Olean, when the defendant intended to cause physical injury to another person, he attempted to cause such injury to such person by means of a dangerous instrument. Further, COLE was sentenced to an indeterminate term of 2 to 4 years; and a term of 1 year in the Cattaraugus County Jail, terms to run concurrently, for his conviction to Burglary in the Third Degree, class D felony; Criminal Mischief in the Fourth Degree, class A misdemeanor.  The incident occurred on August 25, 2016 in the City of Olean, when the defendant knowingly entered unlawfully in a building with intent to commit a crime therein and having no right to do so nor any reasonable ground to believe he had such right, he intentionally damaged property.

THOMAS J. CONKLIN, 32, of Delevan, New York, was sentenced to 3 years probation for his conviction to Petit Larceny, a class A misdemeanor and Identity Theft in the Third Degree, a class A misdemeanor.  The incident occurred on December 6, 2016, in the Town of Yorkshire, when the defendant stole property and did knowingly intend to defraud or assume the identity of another person and thereby obtained goods, money, property or services or used credit in the name of such person. 

ERIK W. HAGEN, 31, of Olean, New York, was sentenced to a term of 1 to 3 years with the New York State Department of Corrections; and 90 days in the Cattaraugus County jail, terms to run concurrently, for his conviction to Attempted Burglary in the Third Degree, a class D felony; Resisting Arrest, class A misdemeanor.  The incident occurred on October 26, 2016, in the City of Olean, when the defendant knowingly entered or remained unlawfully in a dwelling with intent to commit a crime therein and intentionally prevented or attempted to prevent a police officer form affecting an authorized arrest of himself or another person. 

ROBERT C. LEON, 24, presently incarcerated in the Chautauqua County Jail, was sentenced to two, 9 month terms in the Cattaraugus County Jail, each to run concurrently, for his conviction of 2 counts of Attempted Assault in the Second Degree, class D felonies.  The incident occurred on or August 29, 2016 in the Town of Little Valley, when the defendant having been charged with or convicted of a crime while confined in a correctional facility, attempted to cause physical injury to another person. 

JOSHUA R. WANATEE, 34, of Syracuse, New York, was sentenced to two terms of 9 months in the Cattaraugus County Jail, Driver License revoked for 1 year; Ignition Interlock for 6 months, all terms to run concurrently, for his conviction of Driving While Intoxicated, and Aggravated Unlicensed Operation of a Motor Vehicle, a class E felony. The incident occurred on June 20, 2010 in the City of Salamanca, when the defendant operated a motor vehicle while he was in an intoxicated condition.
