Olean man to remain in prison for felony assault

An Olean man will remain in prison serving a five year term for felony assault. On Friday, the State Supreme court rejected an appeal from lawyers representing 24-year-old Mark Burdick II. Burdick was sentenced to prison in 2016 and the High Court said in its rulings that his valid waiver of the right to appeal forecloses his challenge to the severity of the sentence. Burdick is currently at the Fishkill Correctional facility…his earliest release date in February 2020.
