Cattaraugus County District Attorney Report - September 10, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, September 10, 2018:

Arraignments
TOBIAS PRICE, 40, of Niagara Falls, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on November 14, 2017, in the City of Salamanca, when he allegedly possessed and sold a narcotic drug.  The matter has been adjourned for motions.
ERIC REESE, 31, of Jamestown, New York, but presently incarcerated with the New York State Department of Corrections, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, class B felonies; 2 counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies and Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony.  The incident occurred on October 19, 2017, in the City of Olean, when the defendant allegedly knowingly and unlawfully possessed and sold narcotic drugs.  The matter has been adjourned for motions.
Guilty Pleas
AMBER MOHR, 33, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Welfare Fraud in the Fourth Degree, a class A misdemeanor.  The incident occurred between February 1, 2015 and April 30, 2015, in the City of Olean, when she committed a fraudulent welfare act and thereby took or obtained public assistance benefits.  Sentencing is scheduled for November 13, 2018.
SENTENCING
DAKOTA KALTENBACH, 31, of Steamburg, New York, was sentenced to 1 year in the Cattaraugus County Jail for his conviction to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on March 30, 2017, in the Town of Randolph, when the defendant knowingly and unlawfully sold a narcotic drug.
