Livingston County District Attorney Report

After presentation by Joshua J. Tonra, Assistant District Attorney, the following cases were handled in the

Livingston County Court before the Honorable Robert B. Wiggins on May 29, 2018.

JOSEPH W. BENSON, age 49, of York was sentenced after a jury found him guilty of Driving While Intoxicated (E Felony) and Speeding to 5 days incarceration and 5 years probation. He was also ordered to pay a $520 surcharge, a $50 DNA fee, and a $2000 fine. His license was revoked with a requirement to install an Ignition Interlock Device.

CHRISTOPHER W. CAMPBELL, age 37, of Mt. Morris was charged with Criminal Sale Controlled Substance in the Third Degree (B Felony) and) Criminal Possession Controlled Substance in the Third Degree (B Felony). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to June 5, 2018.

DELBERT R. CAPLINGER, JR., age 61, of Delevan was sentenced on a conviction of Driving While Intoxicated (E Felony) to 200 hours community service and 5 years probation to include drug treatment court. He was also ordered to pay a $520 surcharge and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.


RYAN A. GARRISON, age 23, of Atlanta was charged with Criminal Possession of Precursors of Methamphetamine (E Felony), Conspiracy in the Fifth Degree (Misdemeanor), and Petit Larceny (Misdemeanor). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to August 14, 2018.

SEAN M. KOHLMEIER, age 31, of Hunt pled guilty to Attempted Burglary in the Second Degree (D Felony) and the matter was adjourned to August 7, 2018 for sentencing.

DONNA J. MADORRAN, age 61, of Geneseo, charged with Driving While Impaired by the Combination of Drugs or Alcohol and Drugs (E Felony), Driving While Impaired by Drugs (E Felony), Failure to Maintain Lane, and Failure to Keep Right, appeared with her attorney and the matter was adjourned to June 5, 2018.


LOIS L. MARK, age 55, of Prattsburgh pled guilty to Criminal Contempt in the First Degree (E Felony) and the matter was adjourned to August 21, 2018 for sentencing. She was remanded to the Livingston County Jail.

JAMES A. WEGMAN, age 53, of Rochester was sentenced on a conviction of Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (E Felony) and Driving While Impaired by Drugs to 6 months incarceration. He was also ordered to pay a $2,000 fine, a $520 surcharge, and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.
