Cattaraugus County District Attorney Report - March 5, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, March 5, 2018:

Arraignments
SUNNY J. KENNEDY, 44, of  Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Grand Larceny in the Fourth Degree, a class E felony, and 43 counts of Criminal Possession of a Forged Instrument in the Second Degree, class E felonies.  The incidents occurred between October 23, 2016 and May 17, 2017,  when Kennedy allegedly stole property and the value of that property exceeded one-thousand dollars.  The matter has been adjourned for motions.
Sentence

AKYIA CROWE, 32, of Salamanca New York, was sentenced to two terms of nine (9) months in the Cattaraugus County Jail, the installation of an ignition interlock device for a period of one year, and license revocation for a period of one year, to be served consecutively, for her convictions of two counts of Driving While Intoxicated, class D felonies, and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a class A misdemeanor. The incidents occurred on July 16, 2017 and November 1, 2017, in the City of Salamanca, when she operated a motor vehicle on a public highway at a time when she had .08 of one per centum or more by weight of alcohol in her blood.
HENRY DONALDSON, 44, of Olean, New York, was sentenced as a predicate felon to a term of four (4) years with the New York State Department of Corrections plus three (3) years of post release supervision for his conviction of Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment. The incident occurred on June 1, 2016, in the City of Olean, when he attempted to knowingly and unlawfully sell a narcotic substance. 
JAMES HALEY, 55, of Bradford, Pennsylvania, was sentenced to a one (1) year conditional discharge for his conviction of Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on May 17, 2017, in the Town of Carrollton, when he knowingly and unlawfully possessed a narcotic substance. 
KRISTINE GEORGE, 38, of Olean, New York, was sentenced to a term of six (6) months incarceration in the Cattaraugus County Jail for her conviction of Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony.  The incident occurred between May 31, 2017 and June 17, 2017, in the City of Olean, when she knowingly and unlawfully sold a narcotic substance. 
CHARITY MARKS, 44, of Lewis Run, Pennsylvania, was sentenced to a term of five (5) years probation for her conviction of Welfare Fraud in the Third Degree, a class D felony. The incident took place on or about and between October 1, 2015, April 1, 2016 and October 2016, in the City of Olean, when the defendant committed a fraudulent welfare act and thereby takes or obtains public assistance benefits, and the value of those public benefits exceeds three thousand dollars.
JAY P. NELSON, 31, of Salamanca, New York, was sentenced to a term of five (5) years probation, the installation of an ignition interlock device for a period of one (1) year, and revocation of his driver’s license for a period of one (1) year for his conviction of Driving While Intoxicated, a class E felony. The incident took place on May 20, 2017, in the City of Salamanca, when the defendant operated a motor vehicle while he was in an intoxicated condition.
