Cattaraugus County District Attorney Report - May 15, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, May 15, 2017:
Arraignments
ROBERT L. GAMET, 38, of Bradford, P.A., was arraigned and entered a plea of not guilty to an indictment that charges him Criminal Possession of Marijuana in the Second Degree, a class D felony.  The incident occurred on December 10, 2016 in the Town of Hinsdale when the defendant acted jointly and in concert with another and knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing marijuana. The matter has been adjourned for motions.
Guilty Pleas
REBECCA MALDONADO, 26, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Forged Instrument in the Third Degree, class A misdemeanor.  The incident occurred on December 18, 2016 in the Town of Allegany. Sentencing is scheduled for May 14, 2018 upon successful completion of Drug Treatment Court.

JOSHUA WROBEL, 29, of Holland, New York, entered a plea of guilty to indictment that charges him with two counts of Burglary in the Third Degree, class D felonies; Grand Larceny in the Third Degree, a class D felony.  The incidents occurred December 31, 2015 through January 1, 2015, in the Towns of Ashford, Little Valley and Freedom, when he knowingly entered or remained unlawfully in dwellings with intent to commit crimes therein and stole property, some consisting of firearms.  Sentencing is scheduled for August 14, 2017.

FRANK COLE, 33, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempt Assault in the Second Degree, class E felony.  The incident occurred on November 1, 2016 in the City of Olean, when he intended to cause physical injury to another person, he attempted to cause such injury to such person by means of a dangerous instrument. Further, COLE waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, class D felony; Criminal Mischief in the Fourth Degree, class A misdemeanor.  The incident occurred on August 25, 2016 in the City of Olean. Sentencing is scheduled for August 14, 2017.

REGIS L. BUCKTOOTH, 30, of Steamburg, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony; Aggravated Unlicensed Operation in the Second Degree, misdemeanor.  The incident occurred on January 6, 2017 in the City of Salamanca, when the defendant operated a motor vehicle on a public highway with a BAC .13% and knowing that his license or privilege is suspended or revoked.  Sentencing is scheduled for August 14, 2017.

BOBBI JO CODDINGTON, 40, of Allegany, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Welfare Fraud in the Fourth Degree, a class E felony.  The incident occurred between April 2017 and November 2014 in the City of Olean, when the defendant committed a fraudulent welfare act and thereby took or obtained public assistance benefits totaling $1774.00. Sentencing is scheduled for August 14, 2017.

ERIK W. HAGEN, 31, of Olean, New York, entered a plea of guilty to Attempted Burglary in the Third Degree, a class D felony; Resisting Arrest, class A misdemeanor to satisfy a pending indictment.  The incident occurred on October 26, 2016, in the City of Olean. Sentencing has been scheduled for August 14, 2017.
Sentence
RICHARD KRAFT, 21, of Olean, New York, was sentenced to a term of ten months in the Cattaraugus County Jail for his conviction to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on October 26, 2016, in the Town of Allegany, when the defendant knowingly attempted to enter or remain unlawfully in a building with intent to commit a crime therein.

BRANDON E. BUSH, 34, of Olean, New York, was sentenced to a 1 year term of Conditional Discharge for his conviction to Failure to Register with the New York State Sex Offender Registry. The incident occurred on June 11, 2017, in the Town of Randolph, when the defendant, a registered sex offender and knowing the requirements thereof, failed to register with the Division of Criminal Justice Services within ten calendar days after a change of address.

LAURIE CORNELIUS, 47, of Wellsville, New York, was sentenced to time served for her conviction to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class D felony.  The incident occurred between January 15, 2016 and January 22, 2016, in the City of Olean, when the defendant knowingly and unlawfully attempted to possess and sell a controlled substance. 

TODD ULLMAN, 58, of Salamanca, New York,  was sentenced to a term of 60 days in the Cattaraugus County Jail and three years probation; Driver License revoked for 1 year; Ignition Interlock for 12 month and also a term of 15 days to run concurrent for his conviction to Leaving the Scene of a Serious Personal Injury Accident, a class E felony; Driving While Intoxicated, a misdemeanor; and Failure to Stop, a traffic violation.  The incident occurred on April 5th and 6th, 2016, in the City of Salamanca, when the defendant operated a motor vehicle in an intoxicated condition and caused a serious personal injury incident.

IRA LIDGE, 30, of Buffalo, New York, but presently incarcerated in the Cattaraugus County Jail was sentenced  to a term of 2 years plus 2 years post release supervision with the New York State Department of Corrections for his conviction to  Criminal Sale of a Controlled Substance in the Third Degree, class B felony.  The incident occurred on January 29, 2016, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug.
