Allegany County: Three charged with negligent homicide after overdose death

On November 7, 2017, the Bureau of Criminal Investigation (BCI) arrested Robert J. Murray Jr., 19 of Wellsville, NY, Andrew Elliott, 19 of Andover, NY and Spencer S. Carl, 17 of Wellsville, NY for one count of Criminal Negligent Homicide (E Felony) each.
On October 22, 2017, Gregory N. Dunne, 18 of Andover, NY was taken to Jones Memorial Hospital and was found to be deceased upon arrival.  Further investigation revealed that Murray, Elliott, Carl and Dunne allegedly drove from Allegany County to the Rochester area to purchase heroin.  During the trip to Rochester, Dunne was allegedly snorting heroin and was observed to have become unconscious but was still breathing.  According to a press release from State Police, while commuting back from Rochester and presumed Dunne was asleep, they noticed Dunne was not breathing.  They tried to wake Dunne with negative results.  Troopers said Murray dropped off Elliott and Carl before taking Dunne to Jones Memorial Hospital.
All three suspects were processed at SP Amity. They were arraigned at the Town of Amity Court and remanded to the Allegany County Jail on $50,000 cash, $100,000 bond.  All three are to return to Amity Court later in November 2017.
Allegany County DA has been consulted with during this investigation and Wellsville Police Department assisted in this case.
