Livingston County Deputies make two more heroin arrests

AVON: Sheriff Thomas J. Dougherty reports that on February 7, 2017 at about 6:30 p.m., Deputies were called to a convenience store in the Town of Avon to check the welfare of a male subject who was stumbling around in the store. Deputy Matthew Moran and Deputy Jason Butterbrodt arrived on the scene and located the male, 37-year-old Joshua P. Penta from Arkport, NY.  The Deputy Sheriffs allege that Penta drove his car to the store and further believed that Penta was impaired by drugs.  Deputy Brandan Flickner of the Sheriff’s Office STOP DWI Unit and also a certified Drug Recognition Expert (DRE), responded to the scene to assist with the investigation.  Following the investigation Penta was placed under arrest for Driving While Ability Impaired by Drugs.

A subsequent search of the vehicle by Deputies allegedly yielded the discovery of 12 bags of heroin and 2 hypodermic needles. As a result, additional charges were filed against Penta for Criminal Possession of a Controlled Substance in the 7th Degree and Criminal Possession of a Hypodermic Instrument. The alleged discovery also led to charges against a passenger in the car, 33-year-old Daniel R. White from Dansville, NY, also for Criminal Possession of a Controlled Substance in the 7th Degree. Both Penta and White were transported to the Livingston County Jail and turned over to Central Booking Deputies for processing and pre-arraignment detention. Both subjects were arraigned in the Town of Avon Court on February 8th before Justice Michael Torregiano.  The Judge released both Penta and White on their own recognizance (ROR).
