Cattaraugus County District Attorney Report Feb. 21, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, February 21, 2017:

Arraignment

MICHAEL HILL, 32 of Salamanca , New York, was arraigned and entered a plea of not guilty to an indictment that charges him with twenty-three [23] counts of Offering a False Instrument  for Filing in the First Degree, a class E felony; one [1] count of Grand Larceny in the Third Degree, a class D felony.  The incident occurred between December 2012 and November 2013, in the Town of Salamanca, when the defendant allegedly stole property and the value of the property exceeded $3,000.00 and knowing that a written instrument contained a false statement or false information.  The matter has been adjourned for motions.

TINA M. HILL,a/k/a TINA GANSCHOW, a/k/a, TINA TWOGUNS, 55 of Gowanda , New York, was arraigned and entered a plea of not guilty to an indictment that charges her with  two [2] counts of Criminal Possession of a Controlled Substance in the Fifth Degree, class D felonies; two [2] counts  of Criminal Sale of a Controlled Substance in the Fourth Degree, class C felonies.  The incidents occurred on December 21, 2015 and January 14, 2016 in the Town of Persia, when she allegedly knowingly and unlawfully possessed and sold a controlled substance.  The matter has been adjourned for motions.

RONALD J. KUHANECK, SR., 55  of Little Valley , New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two [2] counts of   Driving While Intoxicated, a class E felonies; one [1] count of Aggravated Unlicensed Operation in the First Degree, a class E felony; Operating  Vehicle without Interlock Device, a class A misdemeanor; Failure to Obey Traffic Control Device, a violation; Speed in Zone, a violation; Criminal Impersonation in the Second Degree, a class A misdemeanor. The incident occurred on or October 15, 2016 in the City of Salamanca, when he allegedly operated a motor vehicle on a public highway with a BAC.17% and when he knew or had reason to know that his license or privilege of operating a motor vehicle in the State of New York was suspended or revoked as a result of an prior alcohol related offense. The defendant also impersonated another and does an act in such assumed character with intent to obtain a benefit or to defraud another.  The matter has been adjourned for motions.

Guilty Pleas

ALLEN SINGER, 21, address unknown, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Third Degree, class B felony; Criminal Possession of a Controlled Substance in the Third Degree, class B felony to satisfy a pending indictment.  The incident occurred on May 19, 2016 in the City of Olean, when the defendant knowingly and unlawfully possessed and sold a controlled substance.  Sentencing is scheduled for May 8, 2017.

CHANCE WASHBURN, 22, of Little Valley, New York, entered a plea of guilty to Grand Larceny in the Fourth Degree, a class E felony to satisfy a pending indictment.  The incident occurred on December 9-10, 2015, in the Town of Little Valley, when the defendant stole property and the value of the property exceeded $3,000.  Sentencing is scheduled for May 8.
Sentences

KEITH K. ELLIS, 22, of Killbuck, New York, but currently incarcerated with the Cattaraugus County Jail, was sentenced as a PREDICATE FELONY OFFENDER  to a indeterminate term with the New York State Department of Corrections to 2 to 4 years  for his conviction to Burglary in the Third Degree, a class D felony; 1½- 3 years for his conviction to Criminal Contempt in the First Degree, a class E felony and a term of six [6] months for his conviction to Criminal Contempt in the Second Degree, a class A misdemeanor and restitution. All will run concurrent.  The incident occurred on or about October 10, 2016, in the City of Olean, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein and violated an order of protection.

 CODIE CAPRON, 27, of Little Valley, New York, was sentenced as a PREDICATE FELONY OFFENDER  to an indeterminate term with the New York State Department of Corrections to 2 to 4 years  concurrent on each charge for his conviction to four [4] counts of Burglary in the Third Degree, class D felonies and restitution.  The incident occurred on or about and between July 2016 and September 2016, in the Towns of  Allegany, Hinsdale, Coldspring and Mansfield, when the defendant knowingly entered or remained unlawfully in a building with intent to commit a crime therein and violated an order of protection. 

DANIEL P. RICHARDS, 85, of Buffalo, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 1 to 3 years with the New York State Department of Corrections for his conviction to Failure to Register Address Change With the New York State Sex Offender Registry, a class E felony to satisfy an indictment.  The incident occurred during June 2013, in the Town of Lyndon, when the defendant, a registered sex offender and knowing the requirements, failed to change his address with the Division of Criminal Justice Services. 

BRANDON WARMLEY, 35, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced as a PREDICATE FELONY OFFENDER  to a term of 9 years plus 3 years post release supervision with the New York State Department of Corrections for his conviction to Criminal Possession of a Controlled Substance in the Third Degree and Criminal Sale of a Controlled Substance in the Third Degree, class B felonies.   The incident occurred on September 11, 2015, in the City of Olean, when the defendant knowingly and unlawfully possessed and sold a narcotic drug.  Further , Warmley, was sentenced as a PREDICATE FELONY OFFENDER  to a term of 2 years plus 10 years post release supervision with the New York State Department of Corrections for his conviction to Rape in the Third Degree, a class E felony to run concurrent with Indictment 16-156.   The incident occurred on or about or during June 2014 in Cattaraugus County, when the defendant being 21 years old or more, engaged in sexual intercourse with another person less than 17 years old.
