Former Livingston County Assistant District Attorney arrested for official misconduct

MOUNT MORRIS- Sheriff Thomas J. Dougherty reports the arrest of a Monroe County resident for official misconduct following an investigation by the Sheriff’s Office.

30-year-old Jonathan Francisco, a former Assistant District Attorney with the Livingston County District Attorney’s office, has been arrested and charged with one count of Official Misconduct.

The charge stems from an investigation into an alleged inappropriate relationship Francisco had with a crime victim during his tenure with the Livingston County District Attorney’s Office. Francisco left employment with the District Attorney’s Office in mid-December.

On December 19th, 2024, the victim contacted the Victim Specialist at the Sheriff’s Office and reported the relationship. At that time, Sheriff’s Investigators began an investigation into the allegations. Francisco was arrested on December 23rd, 2024. He was transported and turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.

Francisco was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before the Town of Caledonia Justice Riggi. The Judge did release Francisco on his own recognizance, as the offense did not qualify for bail under the NYS Justice Reform Act.

The Livingston County Public Defender’s Office was present and represented Francisco at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified but did not appear due to the potential conflict of interest.

The investigation was handled by the Criminal Investigations Division with assistance from the Victim Specialist. The Livingston County District Attorney’s Office and The Wayne County District Attorney’s Office also assisted in the investigation.
