Livingston County District Attorney Report

After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on August 21, 2018.

ADAM J. FUETTERER, age 33, of Livonia was sentenced on a conviction of Criminal Possession of a Controlled Substance in the Fifth Degree (D Felony) to time served and 5 years probation. He was also ordered to pay a $325 surcharge, a $50 DNA fee, and his license was suspended.

JOSHUA A. GANG, age 35, formerly of Groveland Correctional Facility was charged with Promoting Prison Contraband in the First Degree (D Felony). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 30, 2018.

ANN MARIE HIGHSMITH, age 40, of Rochester pled guilty to Attempted Criminal Possession Controlled Substance in the Third Degree (C Felony) and the matter was adjourned to October 16, 2018 for sentencing.

A YOUTHFUL OFFENDER was charged with Criminal Possession of Marihuana in the Second Degree (D Felony). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 16, 2018.

A YOUTHFUL OFFENDER was charged with Making a Terroristic Threat (D Felony) and Criminal Mischief in the Fourth Degree (Misdemeanor). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 16, 2018.

JANELLE M. JONES, age 27, of Livonia pled guilty to Grand Larceny in the Third Degree (D Felony) and a violation of probation and the matter was adjourned to October 30, 2018 for sentencing.

LOIS L. MARK, age 55, of Prattsburgh was sentenced on a conviction of Criminal Contempt in the First Degree (E Felony) to 1 1/2 to 3 years in state prison as a second felony offender. She was also ordered to pay a $325 surcharge and a $50 DNA fee. An Order of Protection was issued for the victim.

DAWN M. WILSON, age 53, of Dansville was sentenced on a conviction of Attempted Falsifying Business Records in the First Degree (Misdemeanor) to 3 years probation. She was also ordered to pay a $200 surcharge and a $50 DNA fee.

After presentation by Justin M. Hill, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on August 16, 2018.

WILLIAM J. BEACH, age 21, of Cameron was sentenced on a conviction of Rape in the Third Degree (E Felony) to 6 months incarceration and 10 years probation to include Sex Offender Registration. He was also ordered to pay a $325 surcharge, a $50 DNA fee, and a $1000 Sex Offender Registry Fee. An Order of Protection was issued for the victim.

MICHAEL P. CLARK, age 46, of Dansville was sentenced on a conviction of Aggravated Driving While Intoxicated with a Child (E Felony) to 90 days incarceration and 5 years probation to include electronic home monitoring. He was also ordered to pay a $520 surcharge and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.

MICHAEL F. GERHARDT, age 51, of Livonia admitted violating probation and the matter was adjourned to October 11, 2018 for sentencing. He was remanded to the Livingston County Jail without bail.

KIMBERLY J. HART, age 47, of Mt. Morris admitted violating probation and the matter was adjourned to October 11, 2018 for sentencing. She was remanded to the Livingston County Jail without bail.

A YOUTHFUL OFFENDER admitted violating probation and the matter was adjourned to September 13, 2018 for sentencing. He was remanded to the Livingston County Jail without bail.

JOHN R. LITOLFF, age 33, of Livonia, charged with Criminal Contempt in the First Degree (E Felony), 14 counts of Aggravated Family Offense (E Felony), 5 counts of Criminal Contempt in the Second Degree (Misdemeanor), 8 counts of Attempted Criminal Contempt in the Second Degree (Misdemeanor), 3 counts of Criminal Mischief in the Fourth Degree (Misdemeanor), Obstruction of Governmental Administration in the Second Degree (Misdemeanor), and Harassment in the Second Degree, appeared with his attorney and the matter was adjourned to August 30, 2018.

CELYMAR LOPEZ-CARRION, age 25, of Mt. Morris, charged with Criminal Sale Controlled Substance in the Third Degree (B Felony) and Criminal Possession Controlled Substance in the Third Degree (B Felony), appeared with her attorney and the matter was adjourned to September 13, 2018.

BOBBIE MARRERO, age 46, of Mt. Morris, charged with 2 counts of Criminal Sale Controlled Substance in the Third Degree (B Felony) and 2 counts of Criminal Possession Controlled Substance in the Third Degree (B Felony), appeared with her attorney and the matter was adjourned to September 13, 2018.

AUTUMN F. PIFER, age 31, of Canaseraga, charged with Grand Larceny in the Third Degree (D Felony), Forgery in the Second Degree (D Felony), and Falsifying Business Records in the First Degree (E Felony), appeared with her attorney and the matter was adjourned to September 6, 2018.

ULISES VALENTIN, age 43, of Mt. Morris, charged with 3 counts of Criminal Sale Controlled Substance in the Third Degree (B Felony) and 3 counts of Criminal Possession Controlled Substance in the Third Degree (B Felony), appear with his attorney and the matter was adjourned to September 13, 2018. Bail remains at $ 15,000.

BROOKE S. WAGNER, age 22, of Conesus appeared on a violation of probation and the matter was adjourned to September 6, 2018. She was remanded to the Livingston County Jail without bail. JEFFREY L. WEBB, age 33, of Rochester was charged with Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (E Felony) and Speeding. He was arraigned with his attorney, pled not guilty, and the matter was adjourned to September 6, 2018.

JONATHAN T. WELLS, age 23, formerly of Groveland Correctional Facility, pled guilty to Attempted Promoting Prison Contraband First Degree (E Felony) and the matter was adjourned to October 11, 2018.
