Cattaraugus County District Attorney Report - August 20, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, August 20, 2018:

Arraignments
RAYMOND G. SHAFFER, 41, Olean, New York entered a plea of not guilty to an indictment that charges him with Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony.  The incident occurred on March 29, 2018, in the Town of Allegany. The matter has been adjourned for motions.

GREGORY D. LONG, 41, Humphrey, New York, entered a plea of not guilty to an indictment that charges him with Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony.  The incident occurred on April 3, 2018, in the Town of Humphrey. The matter has been adjourned for motions.

Guilty Pleas
JESSICA MASON, 37, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a misdemeanor; Unsafe Lane Change, a violation.  The incident occurred on February 10, 2018 in the Town of Salamanca when the defendant operated a motor vehicle on a public highway with a BAC .11% and failed to drive her vehicle entirely within a single lane.  Sentencing is scheduled for October 22, 2018.

ANGELO A. CONTRERAZ, 24, of Salamanca, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony to satisfy a pending indictment.  The incident occurred on October 3, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully possessed and sold a controlled substance.  Sentencing is scheduled for October 22, 2018.

ANTHONY PISCITELLI, 26, of Salamanca, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, class C felony to satisfy a pending indictment. The incidents occurred on or about October 18, 2017 and October 19, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully possessed and sold a controlled substance.  Sentencing is scheduled for October 22, 2018.

JENNIFER K. PIERCE, a/k/a JENNIFER K. DELIO, 30, of Salamanca, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Contempt in the Second Degree, a class A misdemeanor and Criminal Mischief in the Fourth Degree, a class A misdemeanor.  The incident occurred on or about May 11, 2018 in the Town of East Otto when the defendant intentionally disobeyed or resisted the lawful process or other mandate of the court and having no right to do so or any reasonable belief that she had such right, she intentionally damaged property of another person.  Sentencing is scheduled for October 22, 2018.

SCOTT KELLEY, 39, of Ellicottville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony and Criminal Mischief in the Fourth Degree, class A misdemeanor.  The incident occurred on or about February 16, 2018 in the Town of Ellicottville when the defendant operated a motor vehicle on a public highway with a BAC .19% and having no right to do so or any reasonable ground, intentionally damaged property of another person.  Sentencing is scheduled for October 22, 2018.
KEITH J. MAYNARD, 44, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Unlawful Manufacture Methamphetamine in the Third Degree, a class D felony and Attempted Criminal Sale of Marijuana in the Second Degree, a class E felony.  The incident occurred on or about March 1, 2018 in the City of Olean when the defendant knowingly and unlawfully possessed a controlled substance with the intent to sell it. Sentencing is scheduled for October 22, 2018.

Sentencing
ADAM BACHMA , 34, of Smethport, Pennsylvania, was sentenced to 1 year in the Cattaraugus County Jail for his conviction to Disseminating Indecent Materials to Minors in the First Degree, both class D felony; Rape in the Third Degree, a class E felony. The incidents occurred on or about or between January 2016 and April 2016, in the Town of Franklinville.
JODY KENJOCKETY, 36, of Hinsdale, New York, was sentenced to a two [2] year term of probation for her conviction to Criminal Possession of Marihuana in the Fourth Degree, a class A misdemeanor.  The incident occurred on or about September 15, 2017, in the Town of Hinsdale, when the defendant knowingly and unlawfully possessed marihuana. 
BRETT W. ABRAMS, 29, of Fredonia, New York, was sentenced as a PREDICATE FELONY OFFENDER   to a 1½- 3 year term with the New York State Department of Corrections and restitution for his conviction to Criminal Mischief in the Third Degree, class E Felony; Criminal Trespass in the Second Degree, class A misdemeanor.  The incident occurred on or about January 28, 2018, in the City of Salamanca, when the defendant intentionally damaged property of another person in an amount exceeding $250.00. 
KEONDRE WOODWARD, 24, of Buffalo, New York,  was sentenced to a five [5] year term of probation and a mandatory state surcharge for his conviction to  Attempted Criminal Possession of a Controlled Substance in the Fourth Degree, a class D Felony to satisfy a pending indictment. The incidents occurred on or about March 2, 2017 and September 9, 2017, in the City of Salamanca.
JOSEPH SEILER, 33, of Ashville, New York, was sentenced to a 1 year term in the Cattaraugus County Jail and restitution for his conviction to Burglary in the Third Degree, a class D felony.  The incident occurred on or about February 14, 2018, in the City of Olean.
KEVIN C. RYAN, 19, of Steamburg, New York, was sentenced to a 1 year term in the Cattaraugus County Jail; Ignition interlock for 1 year; Drivers License Revoked for 1 year for his conviction to Driving While Intoxicated, class E felony; Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, a misdemeanor.  The incident occurred on or about March 10, 2018, in the Town of Hinsdale, when the defendant operated a motor vehicle on a public highway while he was in an intoxicated condition. 
SAMUEL POINTER, III, 36, of Gowanda, New York, was sentenced to 5 years plus 3 years post release supervision with the New York State Department of Corrections and restitution for his conviction to Criminal Possession of Criminal Substance in the Third Degree, class B felony. The incidents occurred on or about and between June 28, 2017 and August 16, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully possessed and sold narcotic drugs.
