Cattaraugus County District Attorney Report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, September 11, 2017:
Arraignment
HENRY J. DONLADSON, 43, of Olean, New York, but presently incarcerated with the New York State Department of Corrections, was arraigned and entered a plea of not guilty to an indictment that charges him with two counts of Criminal Possession of a Controlled Substance in the Third Degree, class B felonies and 2 counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies.  The incidents occurred on May 23, 2016 and June 1, 2016,  in the City of Olean. The matter has been adjourned for motions.

Guilty Pleas
DAREN D. TINGUE, JR., 27, of Machias, New York, entered a plea of guilty to Unlawful Manufacture of Methamphetamine in the Second Degree, class C felony, to satisfy a pending indictment.  The incident occurred on Januray 23, 2017 in the Town of Franklinville, when the he possessed at the same time and location, with intent to use or knowing that another intends to use each product to unlawfully manufacture prepare or produce methamphetamine.  Sentencing is scheduled for October 22, 2018.

TIMOTHY SLATER, 52, of Randolph, New York,  entered a plea of guilty to Criminal Possession of a Controlled Substance in the Second Degree, a class A-II felony, to satisfy a pending indictment.  The incident occurred on January 24, 2017, in the Town of Conewango, when the defendant unlawfully possessed one or more preparations, compounds, mixtures or substances containing menthamphetamine.  Sentencing is scheduled for October 22, 2018.

CHRISTOPHER TERHUNE, 24, of Little Valley, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony, to satisfy a pending indictment.  The incident occurred on June 7, 2017, in the Town of Little Valley, when the defendant knowingly and unlawfully sold a narcotic drug.  Sentencing is scheduled for November 13, 2017.

KEVIN C. RYAN, 23, of Steamburg, New York, but presently incarcerated in the Cattaraugus County Jail waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Grand Larceny in the Fourth Degree, a class E felony.  The incident occurred on November 20, 2016, in the City of Olean, when Ryan stole a motor vehicle valued at over one thousand dollars.  Sentencing is scheduled for October 23, 2017.

TANDE GREENE, 23, of Steamburg, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on October 5, 2016, in the City of Salamanca, when the defendant knowingly and unlawfully possessed a controlled substance.  Sentencing is scheduled for November 13, 2017.

PATRICK M. HIRLIMAN, 27, Olean, New York, entered a plea of guilty to Grand Larceny in the Fourth Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on October 15, 2016, in the City of Olean, when the defendant stole property from another person.  Sentencing is scheduled for November 13, 2017.

Sentences
ERIC A. WESTFALL of Delevan, New York, was sentenced to a term of 3 years probation and a 6 month license revocation for his conviction to Driving While Intoxicated, a class A misdemeanor.  The incident occurred on July 25, 2015, in the Town of Yorkshire, when the defendant operated a motor vehicle in an intoxicated condition.

DOUGLAS J. MOSHER, 34, of Allegany, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to an indeterminate term of 1 ½ to 3 years with the New York State Department of Corrections, for his conviction to Criminal Contempt in the First Degree, a class E felony.  The incident occurred on March 16, 2017, in the Town of Allegany, when the defendant violated an order of protection.

MAURIENNE JIMERSON of Salamanca, New York, was sentenced to a term of 5 years probation, for her conviction to Aggravated Unlicensed Operation in the Second Degree and Driving While Intoxicated, a class E felony.  The incident occurred on December 11, 2016, in the City of Salamanca, when the defendant operated a motor vehicle on a public highway with a BAC of .36, and while she had reason to believe that her driver’s license was suspended or revoked.  

WAYNE A. BABB, JR., 34, of Olean, New York, was sentenced to a term of 3 years probation for his conviction to Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 27, 2016, in the City of Olean, when the defendant, being 18 years old or more and with intent to cause physical injury to a person less than seven, caused such injury to such person.
