Cattaraugus County District Attorney Report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, May 8, 2017:

Guilty Pleas
ROBERT STUCKEY, 50, of Bradford, Pennsylvania, entered a plea of guilty to Criminal Possession of Marihuana in the Third Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on December 10, 2016, in the Town of Hinsdale when he knowingly and unlawfully possessed one or more preparations containing marijauana.  Sentencing is scheduled for June 25, 2018.

ROBERT C. LEON, 24, presently incarcerated in the Chautauqua County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to 2 counts of Attempted Assault in the Second Degree, class D felonies.  The incident occurred on August 29, 2016 in the Town of Little Valley, when the defendant having been charged with or convicted of a crime while confined in a correctional facility, attempted to cause physical injury to another person.  Sentencing is scheduled for August 7, 2017.

NORMA J. HARRISON, 37, of Steamburg, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to 2 counts of Driving While Intoxicated, class E felonies; Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor and Obstructing Governmental Administration, a class A misdemeanor. Sentencing has been scheduled for August 7, 2017.

MICHAEL HILL, 32 of Salamanca , New York, entered a plea of guilty to Grand Larceny in the Third Degree, a class D felony to satisfy a pending indictment.  The incident occurred between December 2012 and November 2013, in the Town of Salamanca, when Hill stole property and the value of the property exceeded $3,000.00 and knowing that a written instrument contained a false statement or false information.  FURTHERMORE, MICHAEL HILL, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on July 2, 2016, in the Town of Coldspring. Sentencing is scheduled for August 7, 2017.

THOMAS J. CONKLIN, 31, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Petit Larcey, a class A misdemeanor and Identity Theft in the Third Degree, a class A misdemeanor. Sentencing is scheduled for August 7, 2017.

AMANDA WISIOREK, 39, of Dayton, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of Methamphetamine Manufacturing Materials in the Second Degree, a class A misdemeanor.  The incident occurred on January 4, 2017, in the Town of Dayton, when she possessed a precursor, a chemical reagent or a solvent with intent to unlawfully manufacture methamphetamine.  Sentencing is scheduled for August 7, 2017.

STACEY SPENCER, JR., 27,  of Olean, New York, entered a plea of guilty to Attempted Robbery in the Third Degree, a class E felony to satisfy a pending indictment.  The incident occurred on March 17, 2016, in the City of Olean, when the defendant attempted to forcibly steal property.  Sentencing is scheduled for August 7, 2017.

MICHAEL BAKER, 53, of Machais, New York, entered a plea of guilty to Vehicular Manslaughter in the First Degree, a class C felony and Aggravated Driving While Intoxicated, a misdemeanor to satisfy a pending indictment.  The incident occurred on August 11, 2013, in the Town of Machias, when the defendant operated a motor vehicle while he was in an intoxicated condition, having a .08% BAC or more and as a result of such intoxication, caused the death of another person.  Sentencing is scheduled for August 7, 2017.

KIMBERLY A. WILBER, 53, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Petit Larceny, a class A misdemeanor.  The incident occurred on March 17, 2017, in the City of Olean, when the defendant stole property.  Sentencing is scheduled for August 7, 2017.

Sentences
ALLEN SINGER, 21, address unknown, was sentenced to 5 years probation for his conviction to Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, class C felony.  The incident occurred on May 19, 2016 in the City of Olean, when the defendant knowingly and unlawfully attempted to possess and sell a controlled substance.
