Bolivar man faces drug charges in Olean

Sheriff Eric A. Butler reports the following incident:

Type of Incident: Traffic Stop

Date: June 15th , 2025 Time: 2340 hours

Location: N. 2 nd St. Olean NY 14760

Details of Incident:

On June 15th , 2025, at approximately 2348 hours, Joseph P. Dempsey, 45, of Olean NY, was taken into custody and at approximately 2349 hours, Brian J. Learn, 43, of Bolivar NY, was taken into custody. Both Dempsey and Learn were occupants of a vehicle that was subject to a traffic stop on N. 2nd St. in the City of Olean due to vehicle and traffic law violations. Dempsey was found to have an active warrant out of the City of Salamanca Police Department and the Town of Cheektowaga Police Department. Following an investigation Learn provided consent to search the vehicle he was operating. Following a vehicle search deputies located a quantity of suspected fentanyl, a quantity of suspected methamphetamine, multiple different packaging materials, a scale, and miscellaneous drug paraphernalia. Both Dempsey and Learn were transported to the Cattaraugus County Sheriffs Office Olean Substation for processing. Dempsey and Learn were processed and then transported to the City of Olean Court for an arraignment on the following charges: Dempsey: Criminal Possession of a Controlled Substance 3 rd Degree, Criminal Possession of a Controlled Substance 7th Degree, Criminally Using Drug Paraphernalia 2 nd Degree – Packaging, and Criminally Using Drug Paraphernalia 2nd

Degree – Scale, Learn: Criminal Possession of a Controlled Substance 3rd Degree, Criminally Using Drug Paraphernalia 2 nd Degree – Packaging, and Criminally Using Drug Paraphernalia 2 nd Degree – Scale, Aggravated Unlicensed Operation 3 rd Degree, and Turn w/ No Signal. Learn was released on his own recognizance and is due in the City of Olean Court at a later date for further proceedings. Dempsey was remanded to the Cattaraugus County Jail with bail set at $25,000, $50,000, and $50,000.
