Call to Order: The meeting was called to order by Public
Works Committee Chairman Dwight Fanton at 1:00 p.m.
Approval of Minutes:
A motion was made by Legislator Graves, seconded by
Legislator Curran, and carried to approve the minutes of July 5, 2017.
A motion was made by Legislator Graves, seconded by
Legislator Hopkins, and carried to approve the minutes of July 10, 2017.
HIGHWAY
Sand and Salt Hauling
Public Works Superintendent Guy James requested permission
to bid their sand and sault hauling. This request was approved on a motion made
by Legislator Graves, seconded by Legislator Curran, and carried.
Gelser Lease
Public Works Superintendent Guy James requested a resolution
to approve the lease of a parcel of land on County Route 15A from Duane and
Terry Gelser. The lease shall be for the term of five years beginning January
15, 2018. The yearly rental will be $250. This request was approved on a motion
made by Legislator Curran, seconded by Legislator Hopkins, and carried. Prepare

Award Hammer and Breaker Bids
Public Works Superintendent Guy James requested permission
to award the bids for their Hydraulic Hammer. They opened bids at 10:00 a.m.,
and received the following three bids:

Mr. James stated they are recommending they award to the low
bidder 5-Star Equipment. This request was approved on a motion made by
Legislator Graves, seconded by Legislator Curran, and carried.
Pile Driver/Air Hammer
Public Works Superintendent Guy James stated they received
the following bid for the Pile Driver/Air Hammer:

Mr. James stated at this point in time they are not going to
award the bid for the pile driver because it does not meet the specifications
required, and they will be going back out to bid at a later date.
SOLID WASTE
Electronics Update
Committee Chairman Fanton stated he, as well as other
constituents, have concerns with how we are now handling the electronics
collection, and has asked both Mr. James and Mr. Scholes if there is a more
accommodating way to handle it. Mr. Scholes stated they held their first event
on July 8, had 150 participants, and collected over 79,000 pounds. Mr. Scholes
stated the event was successful in that they had a lot of participation;
however, he received feedback as well that it is not a convenient process. Mr.
Scholes noted that those who did participate in the event thought it went well.
Mr. Scholes continued that he understands it’s not a convenient process, and he
doesn’t want it to become a situation where electronics are being left on the
side of the road, or dropped at the transfer stations after-hours. Mr. Scholes
went on to say they are open to ideas and plan to come back to the committee in
September with recommendations to make this process more convenient. Legislator
Decker asked how the new process was originally publicized. Mr. Scholes stated
they had it in a newsletter, newspaper, on a handout at the transfer stations,
as well as on the radio. Committee Chairman Fanton stated he recommends they
put some open containers at the Landfill so anyone who wants to dispose of an
old television can go and leave it in the open container and once the
container(s) are full, someone can go and take care of them. Legislator Graves
stated he agrees with that approach.
Wellsville Transfer Station
Legislator Graves stated he has received some phone calls
regarding the configuration of the Wellsville Transfer Station containers being
moved up by the doors, adding that people feel it’s very congested, and there
have been some near misses with the elderly walking across. Legislator Graves
then asked if there is a plan to move them back down. Mr. Scholes stated the
reason they were moved was because they were short-handed and only had one
transfer station operator who was bailing plastic, taking care of the
compacter, as well as helping customers, so they needed to move them up closer
so he could see everything more easily. Mr. Scholes continued that with the
committee’s approval they have been able to hire another operator, who they
expect will be trained very well and quickly, and they hope to have him placed
at the Wellsville station at which time they then can move the containers back
down below.
Unified Court System Agreement
Public Works Superintendent Guy James requested a resolution
to approve the SFY 2017-2018 agreement with the New York State Unified Court
System to provide reimbursement for the cleaning and minor repair of the court
facilities. There is approximately $239,953 in yearly revenue, which has been
budgeted for. Committee Chairman Fanton asked if this is fair compensation for
what we have to do. Mr. James stated, yes, it is. This request was approved on
a motion made by Legislator Curran, seconded by Legislator Graves, and carried.

Transfer of Funds
Public Works Superintendent Guy James requested permission
to transfer funds in the amount of $20,000 as follows:

This request was approved on a motion made by Legislator
Graves, seconded by Legislator Decker, and carried. Notify County Treasurer
Park-n-Ride Contract
Public Works Superintendent Guy James stated bids for the
Park-n-Ride Project were opened on July 25, 2017, and they are recommending
they award to the low bidder Nova Site Company for an amount of $621,606.69.
Funding for this project was established in Resolution No. 315-16, and will be
paid out of Capital Account H5998. Ardent Solutions Mobility Management Planner
Larry Kaminski stated they are pleased that the project came in under budget.
Legislator Graves asked if they are familiar with this company. Mr. James
stated they have done a small project for us once before, adding they did a
good job and are familiar with the municipality requirements that go along with
these projects. Legislator Hopkins asked if the leftover funds in the grant
will be used for anything. Mr. James stated this contract isn’t the only
component of the grant; therefore, he’s not comfortable to say there will be a
surplus yet. Legislator Hopkins then asked if we are still on target with the
timeline for the end of October. Mr. James stated they have established an
aggressive schedule but they believe it’s achievable. This request was approved
on a motion made by Legislator Graves, seconded by Legislator Hopkins, and

Transfer of Funds
Public Works Superintendent Guy James requested permission
to transfer funds in the amount of $9,000 from A1990.429 (Contingency) to
H8197.200 (Waste Water Treatment) to cover Engineering Services for and
Evaluation and Report for the onsite Waste Water Treatment System at the
Allegany County Jail. Mr. James stated they originally were going to take the
funds from the boiler account, but because it is a reserve account, there is
some language that does not allow them to use funds for anything that isn’t
specific to the boilers. Mr. James continued it was recommended to take the
funds from contingency and once they receive an exact cost, it can either be
programmed in as a budget adjustment or they will find another source of
funding to cover it. Legislator Graves asked if there are good reasons for
doing this. Mr. Scholes stated, yes, they have had some problems with the pumps
and they are also looking at the current life expectancy. This request was
approved on a motion made by Legislator Graves, seconded by Legislator Decker,

Tronetti House SEQR Review
Public Works Deputy Superintendent Dean Scholes distributed
to the committee the State Environmental Quality Review (SEQR) Short Form to
determine if the planned demolition of the Tronetti House on Court Street will
or will not result in a significant impact to the environment. Mr. Scholes
began by thanking County Attorney Second Assistant Nora Carnes for her help in
ensuring this was handled correctly. Mr. Scholes then read through the
assessment line by line and requested the committee determine the environmental
impact. Legislator Graves stated from what he’s heard and read; he finds it
appropriate to determine that the proposed action will not result in any
significant adverse environmental impact. Legislator Decker expressed his
disappointment that this house has sat all this time with nothing done, and now
we’re to the point where we have to tear it down, adding that for many years
this was a County owned property and should have been maintained. A motion was
made by Legislator Graves, seconded by Legislator Hopkins, and carried to
prepare a resolution stating that the Board of Legislators has determined,
based on the information and analysis provided, that the proposed action will
not result in any significant adverse environmental impact. Prepare Resolution

Public Works Deputy Superintendent Dean Scholes stated the
elevator work has begun, and there will be times where it will be loud and
inconvenient, and he appreciates everyone’s patience while they are working
through it.
