Cattaraugus County District Attorney Report - Jan. 23, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, January 23, 2017:

Arraignments
ZACHARY WALTERS, 25, of Randolph, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with two (2) counts of Driving While Intoxicated, class E felonies; Consumption of Alcohol in a Motor Vehicle, a violation; Leaving the Scene of an Accident, a violation.  The incident occurred on September 2, 2016, in the Town of Coldspring, when Walters allegedly operated a motor vehicle while he was in an intoxicated condition, having a .12% BAC and knowing, or having cause to know that property damage was caused due to an incident involving the motor vehicle that he was operating.  The case has been adjourned for motions.

Guilty Pleas
LEAH THOMAS, 31, of Great Valley, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Fourth  Degree, a class D felony to satisfy a pending indictment.  The incident occurred on January 15, 2015, in the Town of Great Valley, when Thomas knowingly and unlawfully attempted to possess and sell a narcotic drug.  Sentencing is scheduled for March 27, 2017.

CURTIS A. FORD, 26, of Allegany, New York,  entered a plea of t guilty to Criminal Sale of a Controlled Substance in the Fourth Degree, class C felony to satisfy a pending indictment.  The incidents occurred on or about May 31st and June 1st, 2016, in the City of Olean, when the defendant knowingly an unlawfully possessed and sold a controlled substance.  Sentencing is scheduled for March 27, 2017.

KEITH FUNDERBURK, 28, of Olean, New York,  entered a plea of guilty to Criminal Sale of a Controlled Substance in the Third Degree, class B felony, to satisfy a pending indictment.  The incidents occurred on January 6, 2016 , in the City of Olean, when the defendant knowingly an unlawfully sold a narcotic drug.  Sentencing is scheduled for March 27, 2017.

MICHAEL KNIPPLE, 50, of Olean, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment. The incident occurred on April 9, 2016, in the City of Olean, when Knipple operated a motor vehicle on a public highway with a BAC .24%  and operated a motor vehicle on a public highway and did not indicate an intention to turn to change lanes.  Sentencing is scheduled for March 12, 2018 upon successful completion of Veterans Court.

MICHAEL BOONE, 31, of Ellicottville, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on April 22, 2016, in the Town of Great Valley, when the defendant operated a motor vehicle on a Public Highway with a BAC .14% and operated a motor vehicle at a speed in excess of 55 mph.   Sentencing is scheduled for March 12, 2018 upon successful completion of Drug Treatment Court.

GEORGE DIAMANTES, 28, of Machias, New York, entered a plea of guilty to Driving While Intoxicated, class E felony to satisfy a pending indictment.  The incident occurred on May 7, 2016, in the Town of Machias, when the defendant operated a motor vehicle on a public highway in an intoxicated condition.  Sentencing is scheduled for March 27, 2018 upon successful completion of Interim Probation.

TREVOR D. GRUPA, 19, of Forestville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Rape in the Third Degree, a class E felony and Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred between June 18, 2016 and June 19, 2016 in the Town of Dayton, when the defendant being twenty- one (21) years old or more, engaged in sexual intercourse with another person to whom he was not married and who was less than seventeen years old and acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than  seventeen years old. Sentencing is scheduled for March 27, 2017.

LAURENCE E. ELLIS, 43, of  Leon, New York,  entered a plea of guilty to Criminal Sex Act in the Third Degree, class  E felony; Sex Abuse in the Third Degree, class B misdemeanor and agreed to surrender his Emergency Medical Technician certification,  to satisfy a pending indictment.  The incidents occurred on or about winter 2014 and spring 2015 in the Town of Leon, when the defendant knowing the character and content thereof, he employed, authorized or induced a child less than 17 years of age to engage in a sexual performance. He endangered the moral and mental welfare of a child less than 17 years of age and subjected another person to sexual contact without the latter’s consent.  Sentencing is scheduled for March 27, 2017.
