Refresher: Village of Wellsville regulation of parking - 2023 update

VILLAGE OF WELLSVILLE, NEW YORK

2023 LOCAL LAW NO. 2

REGULATION OF PARKING OF MOTOR VEHICLES ON PUBLIC PLACES

Be it enacted by the Village Board of the Village of Wellsville, Allegany County, New York as

follows:

SECTION I – Parking Prohibited in Designated Locations

The parking of vehicles is hereby prohibited in any of the following locations:

1. Benjamin Street:

A. On the east side of the street

2. Chamberlain Street:

A. On the north side of the street from the North Brooklyn Avenue intersection west to the

Seneca Street intersection.

B. On the south side of the street from the North Brooklyn Avenue intersection west for a

distance of one hundred twenty-five (125) feet.

C. On the south side of the street from the Seneca Street intersection east for distance of six

hundred fifty-five (655) feet.

3. Coats Street:

A. On both sides of the street from the State Route 19 intersection to the John Street

intersection.

4. Earley Street:

A. On the north side of the street, on school days from 7:00a.m. – 3:30p.m. from the North

Brooklyn Avenue intersection to the Hamilton Street intersection.

B. On the north side of the street from the Hamilton Street intersection to the North

Highland Street intersection.

5. East Dyke Street:

A. On the north side of the street from the Route 417 intersection to the South Main Street

intersection.

B. On the south side of the street from the State Route 417 intersection, east for a distance

of two hundred fifty (250) feet.

6. East Fassett Street:

A. On the south side of the street from the North Broad Street intersection, west for a

distance of one hundred forty (140) feet.

B. Two disability permit parking spaces will be provided for Sundays only on the south

side of the street starting eighty-eight (88) feet east of the North Broad Street

intersection.

C. On the north side of the street.

7. East Hanover Street:

A. On the north side of the street.

B. On the south side of the street within seventy-five (75) feet of the driveway entrance to

the fire station.

8. East Madison Street:

A. On the south side of the street from a point one hundred fifty (150) feet west of the Lee

Place intersection, east to the Village line.

B. On the south side of the street, from the North Main Street intersection, east to a point

one hundred (100) feet east of the Maple Avenue intersection.

C. On the north side of the street from its intersection with East Pearl Street to a point one

hundred fifty (150) feet west of the Lee Place intersection.

D. On the north side of the street from the North Main Street intersection to a point two

hundred ten (210) feet east of the Maple Avenue intersection.

9. East Pearl Street:

A. On the north side of the street from the East Madison Street intersection to the Scott

Avenue intersection.

B. On the south side of the street one hundred ninety (190) feet east from the Scott Avenue

intersection for a distance of seventy-five (75) feet.

C. On the south side of the street from the Madison Street intersection, west for a distance

of three hundred thirty-five (335) feet.

10. East State Street:

A. On the south side of the street.

B. On the north side of the street from the Scott Avenue intersection, east for a distance of

three hundred forty (340) feet.

C. On the north side of the street from the Scott Avenue intersection, west for a distance of

one hundred ninety (190) feet.

D. On the north side of the street from intersection of North Broad Street to the intersection

of North Main Street.

11. Fassett Lane:

A. On both sides of the street from the North Highland intersection, west to the Village

line.

12. Gabby Hayes Lane:

A. On the north side of the street.

B. On the south side of the street from the Park Avenue intersection, east to a point eighty

(80) feet west of the North Main Street intersection.

13. Harder Place:

A. On the east side of the street.

B. On the west side of the street, on school days from 7:00a.m. to 3:30p.m.

14. Howard Street:

A. On both sides of the street from the Seneca / North Highland Street intersection south

for a distance of seven hundred seventy-five (775) feet.

15. John Street:

A. On the east side of the street from the Herman Avenue intersection to the Fairview

Avenue intersection.

16. Lee Place:

A. On the west and east side of the street for a distance of seventy-five (75) feet east from

the Madison Street intersection.

17. Loder Street:

A. On the west side of the street from the Oak Street intersection to the East Pearl Street

intersection.

B. On the east side of the street.

18. Lunn Court:

A. On the north side of the street.

B. On the south side of the street from the North Brooklyn Avenue intersection, west for a

distance of sixty (60) feet.

19. Maple Avenue:

A. On the east side of the street from the East State Street intersection to the East Pearl

Street intersection.

20. Martin Street:

A. On the south side of the street from the North Main Street intersection to the Loder

Street intersection.

B. On the north side of the street from the North Main Street intersection, east for a

distance of three hundred (300) feet.

21. McDowell Avenue:

A. On the south side of the street.

B. On the north side of the street from the dead end, east for a distance of thirty-eight (38)

feet.

22. Miller Street:

A. On the north side of the street from the South Broad Street intersection to the East State

Street intersection.

23. North Broad Street:

A. On the east side of the street from the East State Street intersection to the East Fassett

Street intersection.

B. On the east side of the street sixty (60) feet from the East Fassett Street intersection,

north to the dead end of street.

24. North Brooklyn Avenue:

A. On the east side of the street from the West State Street intersection to the Chamberlain

Street intersection.

B. On the west side of the street from the Earley Street intersection to the West State Street

intersection.

C. On the west side of the street, on school days from 7:00am-3:30pm from the Stevens

Street intersection south to the Earley Street intersection.

D. On the west side of the street from the Chamberlain Street intersection south for a

distance of one hundred (125) feet.

25. North Highland Avenue:

A. On the west side of the street from the West State Street intersection north to the Stevens

Street intersection.

B. On both sides of the street from the Stevens Street intersection north to the State Route

417 intersection.

26. North Main Street:

A. On both sides of the street from the Coats Street intersection (dead end) south for a

distance of four hundred fifteen (415) feet.

27. O’Connor Street:

A. Both sides of the street from the Coats Street intersection, south for a distance of six

hundred (600) feet

B. On the north side of the street from the Scott Avenue intersection to the Farnum Street

intersection.

28. Park Avenue:

A. On both sides from the Gabby Hayes Lane intersection to the West Madison Street

intersection.

B. On the east side of the street from the West Madison Street intersection to the West

Pearl Street intersection. (Resolution #24/25-13)

29. Park Lane:

A. On the south side of the street from the North Main Street intersection, east to the 90-

degree corner.

B. On the north side of the street from the North Main Street intersection, east for a

distance of two hundred (200) feet.

30. Pine Street:

A. On the north side of the street from the South Brooklyn Avenue intersection to the South

Highland Avenue intersection.

B. Both sides of the street from the South Highland Avenue intersection west to the Village

line.

31. Pleasant Street:

A. On the west side of the street.

32. Railroad Avenue:

A. Both sides of the street from the East Pearl Street intersection to the Farnum Street

intersection.

33. School Street:

A. On the north side of the street from the Williams Avenue intersection to east to the

Benjamin Street intersection.

34. Scott Avenue:

A. On both sides of the street from the East State Street intersection north for a distance of

one thousand one hundred (1,100) feet.

B. On the east side of the street from the East Pearl Street intersection to the Farnum Street

intersection.

C. On both sides of the street from the East Genesee Street intersection to the O’Connor

Street intersection.

35. Seneca Street:

A. On both sides of the street from the Chamberlain Street intersection to the North

Highland Avenue intersection.

36. South Broad Street:

A. On both sides of the street for a distance of one hundred seventy-five (175) feet north

from the northerly edge of the vehicular bridge.

B. On both sides of the street for a distance of one hundred (100) feet south from the

southerly edge of the vehicular bridge.

37. South Brooklyn Avenue:

A. On the east side of the street from the West Dyke Street intersection, south to the Village

line.

B. On the east side of the street for a distance of two hundred forty (240) feet south from

the West State Street intersection.

C. On the east side of the street from the West Dyke Street intersection to a distance of 800

feet south of the West State Street intersection from 7:00a.m. to 3:30p.m. on school

days.

38. South Franklin Street

A. On the south side of the street from the South Main Street intersection east for a distance

of one hundred fifty-five (155) feet.

39. South Highland Avenue:

A. On the west side of the street from the Pine Street intersection north to the West State

Street intersection.

40. South Main Street:

A. On both sides of the street from a point one hundred sixty-seven (167) feet north of the

northerly border of the Dyke Creek Bridge south to the Village line.

B. On both sides of the street from the State Street intersection south to the southerly curb

line of the Tullar Field driveway.

41. Stevens Street:

A. On the north side of the street for a distance of twenty-five (25) feet from the driveway

entrance to the fire station.

B. On the south side of the street for a distance of seventy-five (75) feet from the driveway

entrance to the fire station.

C. On the south side of the street from the North Brooklyn Avenue intersection to the West

Pearl Street intersection at Memorial Park.

42. University Heights:

A. On both sides of the street beginning November 1st and ending April 30th each year.

43. West Dyke Street:

A. On the south side of the street for a distance of two hundred forty (240) feet east from

the Route 417/19 intersection.

B. On the south side of the street for a distance of one hundred sixty (160) feet west from

the South Main Street intersection.

C. On the north side of the street.

44. West Madison Street:

A. On both sides of the street from the North Main Street intersection to the West Pearl

Street intersection at Memorial Park.

45. West Pearl Street:

A. On the north side from the North Main Street intersection to the Park Avenue

intersection.

B. On the north side of street from the North Brooklyn Avenue intersection to the West

Madison Street intersection.

46. West State Street:

A. On both sides of the street from the Main Street intersection west to the Route 417 / 19

intersection.

B. On the south side of the street starting from a distance one hundred thirty-four (134) feet

east of the Pleasant Street intersection, east to the South Brooklyn Avenue intersection.

C. On both sides of the street from the Brooklyn Avenue intersection, east for a distance of

five hundred forty-two (542) feet.

D. On the west side of the parking lot located between 34 West State Street and 22 West

State Street starting seventy (70) feet from the West State Street intersection, north for a

distance of ninety (90) feet, Monday thru Friday from 7:00a.m. – 5:00p.m., excluding

Village employees.

47. Williams Avenue:

A. On the west side of the street.

48. Witter Avenue:

A. On both sides of the street.

49. Parking outside of a metered parking space within a Parking Meter Zone unless otherwise

marked. (Resolution #24/25-13)

50. On both sides of all Village streets for a distance of thirty (30) feet from any intersection,

unless otherwise posted.

51. On or blocking any public sidewalk or pedestrian walkway within the Village.

52. On or within any Village right-of-way.

53. On any bridge within the Village.

54. Within ten (10) feet of any private or public driveway entrance unless otherwise signed.

55. Within fifteen (15) feet of a fire hydrant.

56. Alongside or obstructing a curb area which has been cut down, lowered or constructed so as

to provide accessibility to the sidewalk unless otherwise signed.

57. In a loading zone.

SECTION II – Parking Meter Zones

1. Parking meter zones as herein referred to shall mean the portions of streets described and

established in this law as zones within which the parking of vehicles shall be controlled,

regulated and inspected with aid of timing devices or meters, herein referred to as parking

meters or meters. The following streets and portions of streets are hereby established as

parking meter zones:

A. East Fassett Street:

i) On the south side of the street from the North Main Street intersection, east for a

distance of one hundred forty-eight (148) feet.

B. East Pearl Street:

i) On the south side of the street from the North Main Street intersection, east for a

distance of two hundred (200) feet.

ii) On the north side of the street from the Loder Street intersection to the North Main

Street intersection.

C. Jefferson Street:

i) On both sides of the street from the North Main Street intersection to the Depot

Street intersection.

D. North Main Street:

i) On the east side of the street starting one hundred thirty (130) feet north of the East

State Street intersection for a distance of two hundred fifteen (215) feet.

ii) On the east side of the street from the East Fassett Street intersection north to a

distance ninety-eight (98) feet south of the Madison Street intersection.

iii) On the east side of the street from the East Madison Street intersection north to a

distance eighty-four (84) feet south of the East Pearl Street intersection.

iv) On the west side of the street from the West Pearl Street intersection south to a

distance ninety-six (96) feet north of the West Madison Street intersection.

v) On the west side of the street starting one hundred seventeen (117) feet south of the

West Madison Street intersection to a distance one hundred eight (108) feet north of

the West Fassett Street intersection.

vi) On the west side of the street from the West Fassett Street intersection to a distance

one hundred twenty (120) feet north of the West State Street intersection.

E. West Pearl Street:

i) On the south side of the street thirty (30) feet west of the North Main Street

intersection for a distance of one hundred sixty-four (164) feet.

2. Meters will be paid Monday – Friday from nine (9) a.m. to five (5) p.m. Saturday, Sunday,

legal holidays or any other time period established by the Village Board are excepted.

SECTION III – Two (2) Hour Parking Zones

The following streets and portions of streets are hereby established as two-hour parking zones.

1. East Genesee Street:

A. On the south side starting thirty (30) feet east of the North Main Street intersection, east

for a distance of two hundred sixty (260) feet.

2. North Main Street:

A. On the east side of the street seventy (70) feet north of the East Pearl Street intersection,

north to the Central Place intersection.

3. West State Street

A. On the west side of the parking lot located between 34 West State Street and 22 West

State Street unless otherwise signed.

SECTION IV – Thirty (30) Minute Parking Zone

The following streets and portions of streets are hereby established as thirty-minute parking zones.

1. South Main Street

A. On the west side of the street thirty (30) feet south of the southerly curb line of the

Tullar Field driveway for a distance of sixty-five (65) feet to the south.

SECTION V – Fifteen (15) Minute Parking Zone

The following streets and portions of streets are hereby established as fifteen-minute parking zones.

1. East Pearl Street

A. On the south side of the street thirty (30) feet west of the Depot Street intersection for a

distance of one hundred twenty-six (126) feet to the west.

2. Gabby Hayes Lane

A. On the south side of the street thirty (30) feet west of the South Main Street intersection

for a distance of fifty (50) feet to the west.

SECTION VI – All Night Parking

The parking of a vehicle is hereby prohibited between the hours of 2 a.m. and 6 a.m. on:

1. All highways within this Village beginning November 1st and ending April 30th each year.

2. In the municipal parking lot located off East Madison Street between North Main Street and

Maple Avenue.

A. Overnight parking is allowable in the Village controlled parking spaces located along

the westerly boundary of the municipal lot.

SECTION VII – Accessible Parking Spaces (ADA)

The Village Board will ensure that there are sufficient accessible parking spaces in the business

district and locate them by resolution. Parking is prohibited in all designated spaces within the

Village without a valid disability permit.

1. Three (3) spaces on North Main Street between the State Street intersection and the Fassett

Street intersection. One (1) space in the parking metered portion of East Fassett Street

2. Four (4) spaces on North Main Street between the Fassett Street intersection and the Madison

Street intersection.

3. Four (4) spaces on North Main Street between the Madison Street intersection and the Pearl

Street intersection.

4. One (1) space in the parking metered portion of Jefferson Street.

5. One (1) space in the parking metered portion of East Pearl Street.

6. Two (2) spaces on West Pearl Street between the North Main Street intersection and the

Madison Street intersection.

7. Three (3) spaces on North Main Street between the East Pearl Street intersection and the

Central Place intersection.

8. Four (4) spaces in the Municipal Lot located off of East Madison Street.

SECTION VIII – Designated Fire Lanes

The parking of a vehicle is hereby prohibited in the following designated fire lanes:

1. Both sides of the lane known as Allen Avenue from the Rauber Street intersection to its end.

2. Both sides of the lane known as Depot Street from the East Pearl Street intersection to its

end.

3. Both sides of the lane known as Eaton Court from the North Main Street intersection to its

end.

4. Both sides of the lane known as Frederick Court from the Pine Street intersection to its end.

5. Both sides of the lane known as Highland Place from the West State Street intersection to its

end.

6. Both sides of the lane known as Whitney Place from the South Brooklyn Avenue intersection

to its end.

7. Eighteen (18) feet from the eastern and northern curb line of the lane known as the Bus Loop

in front of the main entrance of the Wellsville Secondary School.

8. Eighteen (18) feet from the southern curb line of the driveway in front of the Wellsville

Elementary School building.

9. Thirty (30) feet from the front of the buildings within the limits of the Riverwalk Plaza.

SECTION IX – General Regulations

1. The parking of a vehicle is hereby prohibited:

A. Alongside a vehicle that is already parked at the side of the road (double parking).

B. With the left side (driver’s side) wheels of the vehicle against the curb.

2. The parking of a trailer, of any type, that is not hitched to a motor vehicle

is hereby prohibited:

A. On any highway within the Village, between the hours of 2 a.m. and 6 a.m.

B. On any highway within the Village if unregistered.

SECTION X – Penalties

Every person or corporation convicted of any infraction for a violation of any of the provisions

of this Local Law shall be punished by a fine as listed below, or by imprisonment for not more

than fifteen (15) days or by such fine and imprisonment.

1. Meter Violation

A. Will be paid in full with five dollars ($5) if paid within five (5) days of issuance.

B. If payment is made after five (5) days, but before the thirtieth day following the issuance

an additional fifteen dollars ($15) will be required to satisfy the violation.

2. Illegal Violation

A. The specified penalty amount if paid within ten (10) days of issuance.

B. If payment is made after ten (10) days, but before the thirtieth day following the

issuance an additional thirty dollars ($30) will be required to satisfy the violation.

3. Handicap Accessible Parking Violation

A. Will be paid in full with seventy-five dollars ($75) if paid within ten (10) days of

issuance.

B. If payment is made after ten (10) days, but before the thirtieth day following the

issuance an additional fifteen dollars ($75) will be required to satisfy the violation.

4. Failure to pay a penalty after thirty (30) days may result in a warrant for an arrest.

5. Payments may be made at the Village Clerk’s Office located at 23 North Main Street

Monday thru Friday, 9am – 4pm.

6. A ticket maybe contested within ten (10) days of issuance of the ticket by completing a

Parking Ticket Dismissal Request and submitting it to the Village Justice Court.

A. Parking Ticket Dismissal Requests are available at the Village Clerk’s Office, the

Village Police Department located at 46 South Main Street or at

www.wellsvillepolice.com .

7. If any part or parts of this law are for any reasons held to be invalid, such decision shall not

affect the validity of the remaining portions of this law.

SECTION XI – Revisions

1. This law may be amended going forward through Board resolution.

SECTION XII – Effective Date

This Local Law shall take effect immediately upon proper filing of this Local Law with the

Secretary of the State of New York
