Cattaraugus County District Attorney Report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, December 3, 2018:
Arraignments
BETH FLEISCHMAN,39, of Arcade, New York, entered a plea of not guilty to an indictment that charges her with Driving While Intoxicated with a Child, a class E felony; Driving While Intoxicated, a class E felony and Speed in Zone, a violation.  The incident occurred on July 14, 2018, in the Town of Hinsdale. The matter has been adjourned for motions.
STORMY L. EVANS, 26, of Freedom, New York, but currently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges her with Petit Larceny, a class A misdemeanor; Criminal Possession of Stolen Property in the Fourth Degree, a class A misdemeanor; 2 counts of Criminal Possession of Stolen Property in the Fifth Degree, class E felonies; Burglary in the Second Degree, a class C felony; Burglary in the Third Degree, a class D felony and 2 counts of Grand Larceny, class E felonies.  The incident occurred between December 1, 2017 and December 4, 2017, in the Town of Farmersville. The matter has been adjourned for motions.
Guilty Pleas
DAVID C. BENSON, 50, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on January 12, 2018, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a narcotic drug.  Sentencing is scheduled for February 19, 2019.
DAVID STEEPROCK, JR., 35, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operator in the Second Degree, a misdemeanor.  The incident occurred on October 13, 2018, when the defendant operated a motor vehicle on a public highway in an intoxicated condition while having reason to know that his license or privilege to operate a motor vehicle was revoked as a result of a prior alcohol related conviction.  Sentencing is scheduled for February 19, 2019.
BRIAN S. TIDD, 30, of Olean, New York, entered a plea of guilty to Assault in the Third Degree, a class A misdemeanor and Conspiracy in the Fourth Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on December 24, 2017, when the defendant attempted to cause physical injury to another person.  Sentencing is scheduled for February 19, 2019.
NATHANIEL DUBOIS, 43, of Salamanca, New York,  entered a plea of guilty to Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation in the Second Degree, a misdemeanor, to satisfy a pending indictment.  The incident occurred on April 29, 2018, in the Town of Allegany, when the defendant operated a motor vehicle on a public highway in an intoxicated condition, knowing his license was suspended or revoked.  Sentencing is scheduled for March 18, 2019.
SENTENCING
KYLE LAURITSON, 26, of Randolph, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to two to four years with the New York State Department of Corrections for his conviction to Burglary in the Third Degree, a class D felony.  The incident occurred on August 8, 2018, when the defendant knowingly entered unlawfully in a building with the intent to commit a crime therein. 
JESSICA E. LEARN, a/k/a, JESSICA E. LEBLANC, 27, of Allegany, New York, was sentenced to 5 years of Probation for her conviction to  Driving While Ability Impaired by Drugs, a class E felony and her Driver’s License was revoked for 1 year.  The incident occurred on or about June 6, 2018 on Colonial Village in the Town of Allegany.
THOMAS  S. GEORGE, 34, of Salamanca, New York, was sentenced to 5 years of Probation for his conviction to Driving While Intoxicated, a class E felony; Aggravated Unlicensed Operation in the Second Degree, a misdemeanor.  The incident occurred on January 17, 1984, in the City of Salamanca, when he operated a motor vehicle in an intoxicated condition while knowing that his license was suspended or revoked as a result of a previous alcohol related incident, moved his vehicle from a lane unsafely, failing to signal and operating a motor vehicle which was not properly registered. 
TARA L. CRUNETTI, 36, of Olean, New York, was sentenced to 5 years of Probation for his conviction to Criminal Sale of a Controlled Substance in the Third Degree.  The incidents occurred on or about October 27, 2017 and October 31, 2017, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug.
