A month-long investigation conducted by the New York State Police Bureau of Criminal Investigation (BCI) has resulted in charges against a Hornell man. Jason E. Day, 46, was charged with Official Misconduct and Offering a False Instrument for Filing, both class "A" misdemeanors.
The investigation, which was requested by Steuben County District Attorney Brooks Baker, involved the handling of evidence by Day, while acting in his official capacity as a police officer. It is alleged that Day failed to follow departmental policy and procedure in his handling of handguns, which had been voluntarily surrendered. During the course of the investigation, Day is alleged to have provided a false written statement knowing that it would become part of the records of the New York State Police.
Day was issued an Appearance Ticket returnable in the city of Hornell Court on April 24th, 2018 at 10:00 a.m.
