NYS Assemblymember Anna Kelles’ Statement on the Tragic Death of Robert Brooks at Marcy Correctional Facility

 FOR IMMEDIATE RELEASE

The recently released body camera footage showing the horrific and deadly beating of Robert Brooks while in handcuffs in the Marcy Correctional Facility’s infirmary shows a clear and unacceptable abuse of power that resulted in a senseless loss of life as a result of torture. The actions of the 14 officers responsible are horrifying, harm the reputations and safety of hardworking and honest Correctional Officers, and do nothing to reduce crime and improve public safety in our state. I commend the Attorney General for performing an independent investigation through the Office of Special Investigations into this use of force by Correctional Officers. I also applaud the swift response from Governor Hochul and the NYS Department of Corrections and Community Supervision (DOCCS) on terminating the employment of the 14 individuals involved in the assault and I welcome Governor Hochul’s announcement directing Department leaders to implement immediate changes to protect the safety and well-being of all incarcerated individuals and DOCCS personnel in our state’s correctional facilities.

The Attorney General’s investigation, the termination of the officers responsible for Mr. Brooks’ murder, and the implementation of immediate changes at Marcy Correctional Facility are important steps towards accountability. However, the body camera footage of the assault on Mr. Brooks exposes a broader culture of violence and abuse within our correctional facilities. Mass incarceration and the culture it fosters results in tragedies like the death of Mr. Brooks, a culture that is created and sustained when Correctional Officers believe they can engage in such conduct with impunity. We must establish stronger safeguards to hold abusive officers to the highest standards of accountability and end the culture of silence that protects violent and deadly behavior in our prisons. We also need to have open and honest dialogue about the ineffectiveness of our current system of corrections to foster corrections. The current system creates a toxic environment for and among those incarcerated as well as Correctional Officers, healthcare workers, and other personnel. We need to end the focus on solutions that will make the carceral system more toxic and instead emphasize solutions that will incentivize rehabilitation and transformation and ultimately reduce crime and improve public safety. We also need to prioritize alternatives to incarceration and reentry programming that fosters full and healthy reintegration into communities.

My deepest condolences are with Mr. Brooks’ family as they grieve and navigate this unimaginable loss. Mr. Brooks and his community deserve justice and a commitment to systemic reform in our correctional facilities to prevent such an incident from ever occurring again. I stand with the growing calls demanding justice for Mr. Brooks and will work with my colleagues in the state government to ensure accountability.

With solemn regard,

2025 brings new laws for New York state

Governor Kathy Hochul today announced that the new year will bring increased workers’ compensation and Paid Family Leave benefits for workers, while also delivering savings for businesses. Effective January 1, 2025, the minimum weekly benefit for workers’ compensation and the maximum weekly benefit for Paid Family Leave will both go up, while the workers’ compensation assessment rate for employers drops.

“Hardworking New Yorkers shouldn’t have to worry about how they’ll buy food or pay rent when they need time off to care for a new child or family member with a serious health condition, or get injured on the job. Likewise, business owners who have their own bills to pay and families to support also need affordable solutions,” Governor Hochul said. “I’m proud that New York State is finding ways to put money back into the pockets of workers and those who employ them so both the economy and the people can thrive.”

Paid Family Leave

NYS Paid Family Leave provides eligible employees with up to 12 weeks of job-protected, paid time off to bond with a new child, care for a family member with a serious health condition, or to assist loved ones when a family member is deployed abroad on active military service.

Starting January 1, 2025, New Yorkers taking Paid Family Leave may receive up to $14,127.84 in total benefits – an increase of over $300 from 2024. Employees taking Paid Family Leave receive 67 percent of their average weekly wage, up to a cap of 67 percent of the current New York State Average Weekly Wage (NYSAWW), which is $1,757.19 for 2025. This means the maximum weekly benefit will be $1,177.32, and the total possible benefit to an employee is $14,127.84.

Employees will contribute 0.388 percent of their gross wages per pay period to pay for Paid Family Leave in 2025, with a maximum annual contribution of $354.53 (0.388 percent of the NYSAWW). Employees earning less than the NYSAWW will contribute less than the annual cap of $354.53, consistent with their actual wages.

Workers’ Compensation

The NYS workers’ compensation system provides critical financial and medical benefits to workers who are injured or become ill as a result of their jobs, while protecting employers from costly lawsuits. Employers pay an annual assessment to the operating system.

Starting January 1, 2025, the minimum workers’ compensation weekly benefit will increase to $325 per week, in accordance with legislation signed into law by Governor Hochul in September 2023. That’s up from $275 per week in 2024. Prior to January 1, 2024, the minimum weekly benefit had been $150 per week for more than a decade.

On July 1, 2026, the minimum weekly benefit will be indexed to the NYSAWW. The institution of annual increases in the minimum weekly benefit, and eventual indexing to the NYSAWW, will ensure the minimum weekly benefit is more equitable to injured workers going forward.

Savings for Businesses

Additionally, as of January 1, 2025, the workers’ compensation assessment rate for employers will be 7.1 percent of the standard premium or premium equivalent – a 22 percent decrease from 2024 – which is expected to save New York State businesses approximately $191 million.

The employer assessment rates are determined by the NYS Workers’ Compensation Board’s need and budgeted statewide premium. The rate is calculated by dividing the Board’s total estimated annual expenses by a base of total estimated statewide premium. Insurers are required to apply the assessment rate to their premium or premium equivalent.

The assessment rate has been steadily declining in recent years, largely due to prudent management in accelerating the runoff of special workers’ compensation liabilities – known as special funds – which are funded by the assessments. The 2025 rate of 7.1 percent reflects an over 43 percent decrease since 2019, when the assessment rate was 12.6 percent.

Former Livingston County Assistant District Attorney arrested for official misconduct

MOUNT MORRIS- Sheriff Thomas J. Dougherty reports the arrest of a Monroe County resident for official misconduct following an investigation by the Sheriff’s Office.

30-year-old Jonathan Francisco, a former Assistant District Attorney with the Livingston County District Attorney’s office, has been arrested and charged with one count of Official Misconduct.

The charge stems from an investigation into an alleged inappropriate relationship Francisco had with a crime victim during his tenure with the Livingston County District Attorney’s Office. Francisco left employment with the District Attorney’s Office in mid-December.

On December 19th, 2024, the victim contacted the Victim Specialist at the Sheriff’s Office and reported the relationship. At that time, Sheriff’s Investigators began an investigation into the allegations. Francisco was arrested on December 23rd, 2024. He was transported and turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.

Francisco was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before the Town of Caledonia Justice Riggi. The Judge did release Francisco on his own recognizance, as the offense did not qualify for bail under the NYS Justice Reform Act.

The Livingston County Public Defender’s Office was present and represented Francisco at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified but did not appear due to the potential conflict of interest.

The investigation was handled by the Criminal Investigations Division with assistance from the Victim Specialist. The Livingston County District Attorney’s Office and The Wayne County District Attorney’s Office also assisted in the investigation.

The investigation is ongoing and the Sheriff’s Office asks anyone with additional information to contact 844-LCSO-TIP or 585-243-7100.

Together, in over 50 years of marriage, they brought life and the love of Christ to young people, family, neighbors and those in need. Stuart was an Air Force dentist, which brought them to homes in many different locations, including Atlanta, Hawaii, Germany, Indiana, Arkansas, and finally Warner Robins, Georgia.  Wherever they lived, they served their community through the church. In 2022, Carol moved to Houghton to be cared for by her daughter.

Carol is survived by her children: Matthew Beardsley of Warner Robins, GA and Rebecca (Seth) Pullen of Houghton and 3 grandsons: Cash, Ezra and Caleb. Other survivors include her brother David Zahniser (Betsy) of Wellesley, MA and her sister Donna MacGowan (Mark) currently of Townsville, Australia.

In addition to her parents and husband, Carol was predeceased by a grandson, Jack Beardsley.

Carol is best known for her heart to love and serve. She taught a generation of first graders in Sunday school at Westside Baptist Church and helped lead the JV AWANA there. Vacation Bible School was a special project for her every summer, creating a welcoming place and program for children in her community, and teaching them to apply God’s Word to their lives. Always willing to serve, Carol helped many individuals and families by providing meals, rides, timely visits and using her legendary creative problem-solving skills. She and Stuart also provided housing and end-of-life care for her parents and his mother in their home – a value which her family lived out in caring for her.

A life well lived for Jesus and others.
