On May 1, 2019, Deputy Matthew Thomas was assigned to the Sheriff’s STOP DWI Unit when he stopped a vehicle on Lakeville Road in the Town of Avon for a violation of the NYS Vehicle and Traffic Law.
The operator of the vehicle was identified as 32 year old Joseph A. Palma of Fillmore. Passengers in the vehicle were identified as 36 year old Kristofer T. Hubbard and 35 year old Jessica L. Ackerman, both also of Fillmore. A records check revealed that Palma was operating the vehicle with a revoked driver’s license. Palma’s driving privileges had been suspended or revoked a total of nine (9) times.
The Deputy Sheriff also suspected that the occupants were involved in drug activity after seeing items of drug paraphernalia in plain view in the vehicle. A roadside drug investigation was initiated.
The investigation allegedly revealed that the three were in possession of three (3) bags of heroin and one (1) bag of crack cocaine.
Palma was arrested and charged with two (2) counts of Criminal Possession of a Controlled Substance in the 7th Degree and Aggravated Unlicensed Operation of a Motor Vehicle in the 2nd Degree.
Ackerman was arrested and charged with two (2) counts of Criminal Possession of a Controlled Substance in the 7th Degree.
Hubbard was arrested and charged with two (2) counts of Criminal Possession of a Controlled Substance in the 7th Degree and Unlawful Possession of Marijuana as he was also found to be in possession of marijuana.
All three were turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.
All three were later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of North Dansville Judge David Werth. The Judge did remand Palma to the custody of the Sheriff on $250 cash bail or $500 bond. The Judge did release both Hubbard and Ackerman on their own recognizance.
