Cattaraugus County District Attorney Report - Jan. 22, 2019

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, January 22, 2019:

Guilty Pleas

DAMIAN J. BUNDY, 27, of Bradford, PA, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on January 22, 2019, in the Town of Carrollton, when the defendant knowingly and unlawfully possessed a controlled substance and was sentenced to time served.

CHRISTOPHER ROWAND, 38, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on April 13, 2018, in the City of Olean, when the defendant knowingly and unlawfully possessed a controlled substance and was sentenced to a term of 3 months in the Cattaraugus County Jail.

CHASE R. COLE, 23, of Olean, New York, entered a plea of guilty to Assault in the Third Degree, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on March 18, 2018, when the defendant intended to cause serious physical injury to another person, caused such injury to such person and recklessly engaged in conduct which created a grave risk of death to another person.  Sentencing is scheduled for March 25, 2019.

KATIE L. STEBBINS A/K/A KATIE L. STAHLMAN, 29, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Possession of a Controlled Substance in the Fifth Degree, a class B felony and Criminally Using Drug Paraphernalia in the Second Degree, a class A misdemeanor.  The incident occurred on December 1, 2018, in the City of Salamanca, when the defendant knowingly and unlawfully attempted to possess a controlled substance with the intent to sell it and knowingly and unlawfully possessed scales for the purpose of weighing or measuring controlled substances.  Sentencing is scheduled for February 19, 2019.

ERIC REESE, 32, of Jamestown, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony.  The incident occurred on October 19, 2017, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic preparation.  Sentencing is scheduled for May 6, 2018.

Sentencing
SHAWN HUGAR, 32, of Olean, New York, was sentenced to a term of 1 year with the New York State Corrections Department for his conviction to Driving While Intoxicated, a class D felony.  The incident occurred on January 26, 2018, in the City of Olean, when the defendant operated a motor vehicle on a public highway in an intoxicated condition.  Further SHAWN HUGAR was sentenced concurrently to a term of 2 to 4 years with the New York State Department of Corrections for his conviction to Attempted Assault in the Second Degree, class E felony and Conspiracy in the Fourth Degree, class E felony.  The incident occurred on December 24, 2017, in the City of Olean, when the defendant attempted to cause physical injury to another person.

JOHNATHAN BEACH, 31, of Olean, New York, was sentenced to 1 ½ to 4 years with the New York State Department of Corrections for his conviction to Attempted Assault in the Second Degree, a class E felony and Conspiracy in the Fourth Degree, a class E felony.  The incident occurred on December 24, 2017, in the City of Olean, when the defendant with intent to cause serious physical injury to another person and aided by two or more other persons actually present, caused serious physical injury to such person. 

SHANE A. RICE, 29, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, was sentenced to a term of 2 to 4 years with the New York State Department of Corrections for his conviction to Burglary in the Third Degree, a class D felony.  The incident occurred on August 31, 2018, when the defendant knowingly entered unlawfully in a building with the intent to commit a crime therein. 

AYBEK A. KORACHAYEV A/K/A IVAN KORACHAYEV, 24, of Buffalo, New York, was sentenced to a term of 5 years of probation for his conviction to Criminal Sale of Criminal Substance in the Third Degree, a class B felony.  The incident occurred on June 1, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully sold a narcotic drug.  FURTHERMORE, AYBEK A. KORACHAYEV A/K/A IVAN KORACHAYEV, was sentenced to a concurrent term of 5 years of probation for his conviction to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on about September 27, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully sold a narcotic drug.
