GARY G. LERCHEN, 65, of Olean, New York, waived prosecution
by indictment and entered a plea of guilty by Superior Court Information to
Driving While Intoxicataed, a class E felony.
The incident occurred on June 24, 2017, in the Town of Machias, when heoperated
a motor vehicle while he was in an intoxicated state. Sentencing is scheduled for October 2, 2017.
ROBERT ROTE, 25, of Olean, New York, waived prosecution by
indictment and entered a plea of guilty by Superior Court Information to
Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class
C felony. The incident occurred on February
9, 2017, in the City of Olean, when the defendant attempted to unlawfully
possess and sell a narcotic drug.
Sentencing is scheduled for September 17, 2018.

HUGH SMITH, 45, of Springville, New York, was sentenced to
time served for his conviction to Driving While Intoxicated, a class D felony
and Aggravated Unlicensed Operation in the Second Degree, a class A
misdemeanor. The incident occurred on December
17, 2016, in the Town of Machias, when the defendant operated a motor vehicle
on a public highway at a time when he had .08 of one per centum or more by weight
of alcohol in his blood, and when he knew, or had reason to know, that his
license or privilege of operating a motor vehicle was suspended or revoked as a
result of an alcohol related offense.
CHRISTOPHER TOMASIK, 39 of Springville, New York, was
sentenced to 5 years probation for his conviction to Disseminating Indecent
Materials to a Minor in the Second Degree, a class E felony and Endangering the
Welfare of a Child, a class A misdemeanor.
The incident occurred on January 1, 2016, in the Town of Yorkshire, when
the defendant, with knowledge of its character and content, sent an image of a
person or portion of the human body which depicts nudity, sexual conduct or
sado-masochistic abuse and which is likely to be injurious to the physical,
mental or moral welfare of a child less than seventeen years old.
NATHAN C. BILBY, 25, of Olean, New York, was sentenced to an
indeterminate term of 2 to 4 years with the New York State Department of
Corrections for his conviction to Grand Larceny in the Fourth Degree, a class E
felony. The incident occurred on August
20, 2016, in the City of Olean, when the defendant stole property and the
property consisted of a credit card or debit card.
KYLE LAURITSON, 25, of Celeron, New York, was sentenced to 5
years probation for his conviction to Attempted Burglary in the Third Degree, a
class E felony. The incident occurred on
October 20, 2016, in the Town of Randolph, when the defendant knowingly and
unlawfully attempted to enter a building with the intent to commit a crime
therein.
