Wyoming County: Man charged in beer bottle assault

A Cheektowaga man was arrested on Wednesday following the lengthy investigation of an assault that occurred at around 2:30 a.m. on July 3, 2016 in the parking lot at the Jam in the Valley Concert.  An Angola man was in his vehicle when he was struck in the face with a beer bottle causing serious injuries.  The suspect fled, however his DNA was obtained from the bottle which was recovered inside the vehicle following the assault.  Tylor Phinney –age 21 of Cheektowaga, N.Y. was charged with felony Assault in the Second Degree.  Phinney, who is currently on Wyoming County Probation from other unrelated charges, was arraigned before Wyoming County Court Judge Mohun and was released back to the Wyoming County Pre- Trial Probation Program.   Phinney is scheduled to appear back in the Town of Sheldon Court at a later date.  Deputy Mike Majtyka, Deputy Chance Sampson, Forensic Technician Deputy Steve Miller, Wyoming County Probation Officer Gene Traxler and Erie County Sheriff’s Detective Shawn Hettiger all assisted with the investigation.
