Cattaraugus County District Attorney report for Nov. 13, 2017


Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, November 13, 2017:

Arraignment
CHESTER F. PIWOWARCZYK, 18, of Springville, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with 7 counts of Burglary in the Third Degree, class D felonies; 6 counts of Petit Larceny, class A misdemeanors; 6 counts of Criminal Mischief in the Fourth Degree, class A misdemeanors; 2 counts of Criminal Possession of Stolen Property in the Fifth Degree, class A misdemeanors and 2 counts of Endangering the Welfare of a Child, class A misdemeanors.  The incidents occurred during August 2017, in the Town of Yorkshire. The case has been adjourned for motions.
Guilty Pleas
ANDRE BENEFIELD, 24, of Buffalo, New York but currently incarcerated with the New York State Department of Corrections, entered a plea of guilty to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment. The incident occurred on March 11, 2017, in the City of Olean, when he attempted to knowingly and unlawfully possess a narcotic drug. Sentencing is scheduled for January 16, 2018.
PHILLIP J. GOODWILL,34, of Humphrey, New York, waived prosecution  by indictment and entered a plea of guilty by Superior Court Information to Unlawful Manufacturing of Methamphetamine in the Third Degree, a class D felony. The incident occurred on August 28 in the City of Salamanca, when he possessed with intent to use, or knowing that another intends to use such product to unlawfully manufacture, prepare, or produce, methamphetamine, two or more items or laboratory equipment, and two or more precursors, chemical reagents, or solvents in any combination. Sentencing is scheduled for January 16, 2018.
DANA LICHY, 31, of Salamanca, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment. The incident occurred on July 20, 2017, in the City of Salamanca, when he knowingly and unlawfully possessed a narcotic drug. Sentencing is scheduled for January 28, 2019 pending the successful completion of Drug Treatment Court.
ANDREW NOSBISCH, 29, of Angola, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony. The incident occurred on July 30, 2017 in the Town of Ellicottville. Sentencing is scheduled for February 5, 2018.
RYEN T. PUTT, 26, of Olean, New York, waived prosecution  by indictment and entered a plea of guilty by Superior Court Information to Criminal Trespass in the Second Degree, a class A misdemeanor and Petit Larceny, a class A misdemeanor. The incident occurred on July 4, 2017, in the Town of Portville, when the defendant knowingly entered and remained unlawfully in a dwelling and stole property. Sentencing is scheduled for January 16, 2018.
DAREL D. TINGUE, 27, of Java Center, New York, entered a plea of guilty to Criminal Possession of Marijuana in the Fourth Degree, a class A misdemeanor to satisfy a pending indictment. The incident occurred on November 30, 2016, in the Town of Yorkshire, when the defendant knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing marijuana and the preparations, compounds, mixtures, or substances are of an aggregate weight of more than two ounces The defendant was sentenced to a one (1) year conditional discharge.
Sentences
TANDE GREENE, 23, of Steamburg, New York, was sentenced to a term of three (3) years probation for her conviction of Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on October 5, 2016, in the City of Salamanca, when the defendant knowingly and unlawfully possessed a controlled substance.
LAWRENCE C. SMITH, 30, of Olean, New York, was sentenced to a term of three (3) years probation for his conviction of Criminal Possession of Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on March 11, 2017, in the City of Olean, when the defendant knowingly and unlawfully possessed a controlled substance.
LINDSAY M. ULLMAN, 35, of Salamanca, New York, was sentenced to a term of five (5) years probation for her conviction of Criminal Possession of Controlled Substance in the Fifth Degree, a class D felony.  The incident occurred on January 6, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully possessed a controlled substance with the intent to sell it.
