Cattaraugus County District Attorney report - August 13, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, August 13, 2018:

Arraignments
INTISAR SPENCER, 39, of Niagara Falls, New York, entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on December 27, 2018, in the City of Olean, when the Spencer allegedly knowingly and unlawfully possessed and intended to sell a narcotic drug.  The matter has been adjourned for motions.
Guilty Pleas
DAMION R. TAYLOR, 22, of Salamanca, New York but presently incarcerated in the Cattaraugus County Jail, entered a plea of guilty to Manslaughter in the Second Degree, a class C felony; Leaving the Scene of an Incident without Reporting Serious Physical Injury, a class D felony; Vehicular Manslaughter in the Second Degree, a class D felony; Reckless Endangerment in the First Degree, a class D felony; Criminally Negligent Homicide, a class E felony; Reckless Driving, a misdemeanor and Driving While Intoxicated, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on November 18, 2017, in the Town of Salamanca, when the defendant was operating a motor vehicle in an intoxicated condition and recklessly caused the death of another person.  Sentencing is scheduled for October 15, 2018.

EDWARD WAGONER, 42, of Olean, New York, waived prosecution by indictment and entered a plea of guilty to Superior Court Information to Criminal Possession of a Precursors of Methamphetamine, a class E felony.  The incident occurred on June 28, 2018, in the City of Olean, when the defendant possessed a precursor and a solvent or chemical agent with intent to unlawfully manufacture methamphetamine.  Sentencing is scheduled for October 15, 2018.

DANIEL G. TIDD, JR.,28, of Olean, New York, entered a plea of guilty to Attempted Assault in the Second Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on December 24, 2017, in the City of Olean, when the defendant intended to cause physical injury to another person.  Sentencing is scheduled for October 15, 2018.

AMANDA A. WEED, 31, of Olean, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on April 4, 2018, in the City of Olean, when she knowingly and unlawfully possessed a narcotic preparation.  Sentencing is scheduled for August 16, 2019.
Sentencing
BRADLEY STAHLMAN JR., 20, of Salamanca, New York, was sentenced to 6 months in the Cattaraugus County Jail for his conviction to Criminal Possession of a Firearm, a class E felony.  The incident occurred on August 4, 2017, in the City of Salamanca, when he knowingly possessed a firearm.

FAY M. SAGE, 49, of Great Valley, New York, was sentenced to a 3 year Conditional Discharge for her conviction to Driving While Intoxicated, a class E felony.  The incident occurred on January 7, 2018, in the City of Olean, when the defendant operated a motor vehicle on a public highway at a time when she had .14 of one per centum or more by weight of alcohol in her blood.

LAYTON T. WALKER, 19, of Olean, New York but presently in the Cattaraugus County Jail, was sentenced to 1 year in the Cattaraugus County Jail, for his conviction to Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, a class E felony.  The incident occurred on November 2, 2017, in the City of Olean, when the defendant knowingly and unlawfully attempted to sell a controlled substance.

PHILLIP J. GOODWILL, 35, of Humphrey, New York, was sentenced to 5 years of probation for his conviction to Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony.  The incident occurred on August 28, 2017, in the City of Salamanca, when he possessed at the same time and location, with the intent to use, or knowing that another intended to use each such product to unlawfully manufacture, prepare or produce methamphetamine and  knowingly and unlawfully attempted to possess substances containing methamphetamines.
