“The Supreme Court has ruled that the challenge is invalid,” said former Steuben County Republican Chairman William Hatch. “Patrick McAllister remains a candidate for Surrogate Judge. This is a victory for all voters, who are now assured of having a choice in the election.”
The
state court upheld the 4-0 bipartisan decision on July 26 by the Steuben County Board of Elections commissioners and deputy
commissioners in favor of voter petitions securing McAllister a spot on the
Independence Party line.
The challenge, filed by surrogate judge candidate Chauncey Watches’ campaign, centered around a military veteran’s petition which included a bar through the number “7” – a standard military notation. The challenge claimed the number was a “2” instead, which would have invalidated the veteran’s petition. The court ruled the number was a “7” and the veteran’s entry was valid.
The state court decision means McAllister will be on the Republican, Conservative and Independence party lines for the Sept. 12 primary day.
