reported the following activity in Cattaraugus County Court on Monday, April 3,
2017:
Guilty Pleas
DARRYL HARPER, 48, of Friendship, New York, waived prosecution
by indictment and entered a plea of guilty by Superior Court Information to
Attempted Burglary in the Third Degree, a class E felony. The incident occurred on December 4, 2016, in
the City of Olean, when the defendant knowingly and unlawfully attempted to
enter a building with intent to commit a crime therein. Sentencing is scheduled for April 10, 2017.
DARRON SHERIDAN, 23, of Hartford, Connecticut, but presently
incarcerated in the Cattaraugus County Jail, waived prosecution by indictment
and entered a plea of guilty by Superior Court Information to two counts of
Criminal Possession of a Forged Instrument in the Second Degree, a class D
felony, and Criminal Impersonation in the Second Degree, a class A misdemeanor. The incident occurred on February 15, 2017,
in the Town of Randolph, when the defendant with knowledge that it was forged,
and with the intent to defraud, deceive or injure another, knowingly possessed
a forged credit card, and impersonated another in such assumed character with
intent to obtain a benefit or defraud another.
Sentencing is scheduled for June 26, 2017.
DARRIN D. SHERIDAN, 23, of Hartford, Connecticut, but
presently incarcerated in the Cattaraugus County Jail, waived prosecution by
indictment and entered a plea of guilty by Superior Court Information to
Attempted Criminal Possession of a Forged Instrument in the Second Degree, a
class E felony. The incident occurred on
February 15, 2017, in the Town of Randolph, when the defendant with knowledge
that it was forged, and with the intent to defraud, deceive or injure another,
knowingly attempted to possess a forged credit card. Sentencing is scheduled
for June 26, 2017.
DENNIS P. STRADER, 44, of Machias, New York, waived
prosecution by indictment and entered a plea of guilty by Superior Court
Information to Criminal Mischief in the
Fourth Degree, a class A misdemeanor.
The incident occurred on February 2, 2017, in the Town of Machias, when
the defendant intentionally damaged the property of another person. Sentencing is scheduled for June 26, 2017.
GARY O. THOMAS, 29, of Salamanca, New York, entered a plea
of guilty to Criminal Possession of a Controlled Substance in the Seventh Degree,
a class A misdemeanor. The incident
occurred on February 27, 2016, in the City of Salamanca, when the defendant
knowingly and unlawfully possessed a narcotic drug. Sentencing is scheduled for April 10, 2017.
ROBERT WASHINGTON, 37, of Olean, New York, entered a plea of
guilty to Criminal Sex Act, Third Degree, a class E felony. The incident occurred between March 21, 2016
and June 16, 2016, in the City of Olean, when the defendant engaged in oral
sexual conduct with another person without such person’s consent where such
lack of consent is be reason of some factor other then incapacity to
consent. Sentencing is scheduled for
June 26, 2017.
NATHAN C. BILBY, 25, of Olean, New York, entered a plea of guilty
to Grand Larceny in the Fourth Degree, a class E felony to satisfy a pending
indictment. The incident occurred on August
20, 2016, in the City of Olean, when the defendant stole property and the
property consisted of a credit card or debit card. Sentencing is scheduled for July 31, 2017.
Sentences
CHERI BURTMAN, A/K/A CHERI BEARFIELD, 35, of Olean, New
York, but presently incarcerated in the Cattaraugus County Jail, was sentenced
as a PREDICATE FELONY OFFENDER to a term of 1 year with the Cattaraugus County
Jail for her conviction to Aggravated Unlicensed Operation in the Second
Degree, a class E felony and Operating a Motor Vehicle On Public Highway While
Using Mobile Phone, a violation. The
incident occurred on September 14, 2016, in the City of Olean, when the
defendant knowingly and unlawfully operated a motor vehicle on a public highway
while she knew or had reason to know that her license or privilege of operating
a motor vehicle in the State of New York was suspended or revoked, and also
operated a motor vehicle upon a public highway while using a mobile telephone
to engage in a call while such vehicle was in motion. Furthermore, CHERI BURTMAN, A/K/A CHERI
BEARFIELD, was sentenced to 3 years with the New York State Department of
Corrections and 2 years of post release supervision for her conviction to
Attempted Criminal Sale of a Controlled Substance in the Fourth Degree, a class
C felony. The incident occurred on February
25, 2016, in the City of Olean, when the
defendant knowingly and unlawfully sold a narcotic preparation. Both sentences are to run concurrent.
JEFFREY CAMPBELL, 33, of Olean, New York, was sentenced to a
1 year conditional discharge for his conviction to Criminal Possession of a
Controlled Substance in the Seventh Degree, a class A misdemeanor. The incident occurred on December 4, 2014, in
the City of Olean, when the defendant knowingly and unlawfully possessed a
narcotic drug.
NICHOLAS R. KAHABKA, 22, of Springville, New York, was
sentenced to 1 year in the Cattaraugus County Jail for his conviction to
Attempted Burglary in the Second Degree, a class D felony. The incident occurred on September 22, 2015,
in the Town of Yorkshire, when the defendant knowingly and unlawfully attempted
to enter a building with intent to commit a crime therein.
PAUL M. KEMERY, 52, of Bradford, Pennsylvania, was sentenced
to 5 years probation and 240 hours of community service, his driver’s license
revoked for 1 year, and an Ignition Interlock for 1 year, for his conviction to
Driving While Intoxicated, a class E felony.
The incident occurred on May 14, 2016, in the City of Olean, when the
defendant operated a motor vehicle in an intoxicated condition, having a .17%
BAC.
KYLE H. LUNN, 21, of
Richburg, New York, upon successful completion of drug treatment court,
was sentenced to a 1 year conditional discharge for his conviction to Forgery
in the Third Degree, a class A misdemeanor.
The incident occurred between December 30, 2015 and January 6, 2016, in
the City of Olean, when the defendant with intent to defraud, deceive or injure
another, falsely made, completed or altered a written instrument, and stole
property.
JUSTIN D. VREELAND, 35, of Olean, New York, but presently
incarcerated in the Cattaraugus County Jail, was sentenced to 2 ½ years with
the New York State Department of Corrections and 3 years of post release
supervision, as a PREDICATE FELONY OFFENDER, to Attempted Criminal Sale of a
Controlled Substance in the Third Degree, a class C felony. The incident occurred on April 1, 2016, in
the City of Olean, when the defendant knowingly and unlawfully attempted to
sell a narcotic drug.
FURTHERMORE, JUSTIN D. VREELAND, was sentenced to 1 ½ - 3
years with the New York State Department of Corrections for his conviction to
Attempted Assault in the Second Degree, a class E felony. The incident occurred on October 9, 2016, in
the City of Olean, when the defendant attempted to cause serious physical
injury to another person. Both sentences are to run concurrent.
TREVOR D. GRUPA, 19, of Forestville, New York, but presently
incarcerated in the Chautauqua County Jail, was sentenced to 6 months in the
Cattaraugus County Jail, followed by 10 years probation for his conviction to
Rape in the Third Degree, a class E felony and 3 years probation for
Endangering The Welfare of a Child, a class A misdemeanor, both to run
concurrent. The incidents occurred between
June 18, 2016 and June 19, 2016, in the Town of Dayton, when defendant, being
21 years old or more, engaged in sexual intercourse with another person to whom
he was not married, and who was less than 17 years old and knowingly acted in a
manner likely to be injurious to the physical, mental or moral welfare of a
child less than 17 years old.
WILLIAM WARREN, 19, of Olean, New York, was sentenced to 5
years probation plus restitution for his conviction to Criminal Sale of a
Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on May 25, 2016, in the
City of Olean, when the defendant knowingly and unlawfully sold a narcotic
drug.
