On July 13th, 2020, at around 7:40p.m., Deputies received
the report of a possible assault on a child at a residence on South Main

Sweeney (46, of Castile) had gotten into a verbal argument with a child and
Sweeney struck the child in the face. Following the investigation, Sweeney was

On June 28th, 2020, at around 5:40p.m., Deputies of the
Wyoming County Sheriff’s Office received a trespassing complaint of an
all-terrain vehicle riding through freshly seeded hay fields behind a residence
on Pee Dee Road in the Town of Java. Deputies later learned the property was
owned by a farm on State Route 98 and the suspect was operating the all-terrain
vehicle on private property without permission. While Deputies were attempting
to locate the suspect in the fields, the property owners caught the suspect and
detained him until Deputies arrived. The
suspect was identified as David J. Kleinsmith Jr. (33, of North Java) and while
speaking to Kleinsmith about the trespassing complaint, Deputies believed
Kleinsmith was under the influence of alcohol. Video evidence from the property
owner showed Kleinsmith operated the all-terrain vehicle on State Route 98 and
Kleinsmith was asked to perform standardized field sobriety testing. Following
the standardized field sobriety testing, he was arrested for driving while
intoxicated and transported to the Wyoming County Sheriff’s Office where
Kleinsmith submitted to a Datamaster DMT breath test. He was ultimately charged
with driving while intoxicated, operating a motor vehicle with a .08% BAC or
greater, unlawful operation of ATV on public highway, operate unregistered ATV,
unlawful operation of ATV of private property without consent, operate
uninsured ATV, operate ATV with no helmet and refusal to take pre-screen breath
test. Kleinsmith was released with appearance tickets and is scheduled to
appear in the Town of Java Court at a later date.
