Olean men charged with drug possession during I-390 stop

PRESS RELEASE:

AVON: Livingston County Sheriff Thomas J. Dougherty reports the arrest of two Olean, New York residents on drug related charges after a traffic stop. On July 18, 2019 at approximately 2:55 a.m, Deputy Shawn Whitford was assigned to the Sheriff’s Office Operation Safe Interstate Initiative when he stopped a vehicle on Interstate 390 in the Town of Avon for a violation of the NYS Vehicle and Traffic Law.
 

The operator of the vehicle was identified as 31-year-old Kristofer D. Sosa. The Deputy Sheriff suspected that Sosa was under the influence of alcohol and drugs and conducted a roadside DWI investigation which included the performance of standardized field sobriety tests. At the conclusion of the roadside investigation, Sosa was taken into custody for DWI. The roadside investigation also revealed that Sosa was allegedly in possession of 7 bags of fentanyl.

Also, during the roadside investigation, it was found that a passenger in the vehicle, 27-year-old Jud E. Clark, was allegedly in possession of 8 bags of fentanyl.
Sosa was transported to the Sheriff’s Office in Geneseo where Deputy Matthew Thomas, who is a Certified Drug Recognition Expert, conducted a drug evaluation on Sosa. It was Deputy Thomas’ expert opinion that Sosa was under the influence of alcohol and cannabis and could not operate a vehicle in a safe manner.
Sosa was charged with Felony Driving While Ability Impaired by a Combination of Drugs and Alcohol, Criminal Possession of a Controlled Substance in the 7th Degree (class A Misdemeanor), and the violation of the Vehicle and Traffic Law. The DWAI charge was a felony as Sosa had a previous DWI related conviction on January 11, 2017.
Clark was arrested and charged with Criminal Possession of a Controlled Substance in the 7th Degree (class A Misdemeanor).
Both Sosa and Clark were turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. The District Attorney’s Office was contacted in regards to Sosa’s bail due to the felony level charge. It was recommended that Sosa be held on $3,000 cash bail or $6,000 bond. Sosa and Clark were later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Livonia Judge Margaret Linsner. The Judge did remand Sosa to the custody of the Sheriff on the recommended bail of $3,000 cash or $6,000 bond. Clark was remanded to the jail on $500 cash bail or $1,000 bond. Also assisting with the investigation from the Sheriff’s Office was Deputy Bryan Mann.
