Cattaraugus County District Attorney Report - October 1, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, October 1, 2018:
Arraignments

SEAN VAUGHN, 38, of Salamanca, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, class A misdemeanor; Criminal Use of Drug Paraphernalia in the Second Degree, class A misdemeanor; Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 26, 2018, in the City of Salamanca. The matter has been adjourned for motions.

TABITHA J. BARRICK, a/k/a, TABITHA CRAWFORD, 33, of Olean, New York, entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony;  Criminal Use of Drug Paraphernalia  in the Second Degree, class A misdemeanor.  The incident occurred on May 17, 2018, in the City of Olean, when she allegedly knowingly and unlawfully possessed a controlled substance with the intent to sell it.   The matter has been adjourned for motions.

ALLY WANATEE, 26, of Salamanca, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, class A misdemeanor; Criminal Use of Drug Paraphernalia  in the Second Degree, class A misdemeanor; Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 26, 2018, in the City of Salamanca, when the defendant allegedly acted jointly and in concert with another, each aiding and abetting the other knowingly and unlawfully possessed a controlled substance with the intent to sell it.   The matter has been adjourned for motions.

ALLY WANATEE, 26, of Salamanca, New York, entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, class A misdemeanor; Criminal Use of Drug Paraphernalia  in the Second Degree, class A misdemeanor; Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 26, 2018, in the City of Salamanca. The matter has been adjourned for motions.

FRISCARO, 23, of Kill Buck, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, class A misdemeanor; Criminal Use of Drug Paraphernalia in the Second Degree, class A misdemeanor; Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 26, 2018, in the City of Salamanca. CALKINS, 32, of Salamanca, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, class A misdemeanor; Criminal Use of Drug Paraphernalia  in the Second Degree, class A misdemeanor; Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on or about March 29, 2018, in the City of Salamanca. The matter has been adjourned for motions.

SARA L. SEELEY, 29, of Gowanda, New York, entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Second Degree, a class A-II felony. The incident occurred on May 14, 2018, in the Town of Persia, when the she allegedly knowingly and unlawfully possessed one or more preparations, compounds, mixtures or substances containing a narcotic drug that had an aggregated weight of four or more ounces.   The matter has been adjourned for motions.

Guilty Pleas

JESSICA JUDA, 29, of Delevan, New York., entered a plea guilty to Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, a class E felony to satisfy a pending indictment.  The incident occurred on March 29, 2018, in the Town of Franklinville. Sentencing is scheduled for November 18, 2019.

JESSICA E. LEARN, a/k/a, JESSICA E. LEBLANC, 27, of Allegany, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to  Driving While Ability Impaired by Drugs, a class E felony.  The incident occurred on June 6, 2018 on Colonial Village in the Town of Allegany, New York, when the defendant operated a motor vehicle on a public highway while her ability to do so was impaired by a substance listed in PHL 3306.  Sentencing is scheduled for December 3, 2018.

KYLE LAURITSON, 26, of Randolph, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony.  The incident occurred on August 8, 2018, when the defendant knowingly entered unlawfully in a building with the intent to commit a crime therein.  Sentencing is scheduled for January 7, 2019.

RANDY KENYON, 40, of Olean, New York, entered a plea guilty to Criminal Sale of a Controlled Substance in the Fifth Degree, class D felony to satisfy a pending indictment.  The incident occurred between July 25, 2017 and August 29, 2017, in the City of Olean, when the defendant knowingly and unlawfully possessed and sold a controlled substance.  Sentencing is scheduled for January 7, 2019.

JAMIE P. GREEN, 43, of Humphrey, New York, entered a plea of guilty to Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, a class E felony to satisfy a pending indictment.  The incident occurred on April 3, 2018, in the Town of Humphrey, when the defendant possessed and intended to use such product to unlawfully manufacture, prepare or produce methamphetamine.   Sentencing is scheduled for January 7, 2019.

TARA L. CRUNETTI, 36, of Olean, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Third Degree, a class B felony to satisfy a pending indictment.  The incidents occurred on October 27, 2017 and October 31, 2017, in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug. Sentencing is scheduled for January 7, 2019.

BRETT M. WILLIAMS, 22, of Steamburg, New York, entered a plea of guilty to Grand Larceny in the Fourth Degree, class E felony and Driving While Intoxicated, a misdemeanor to satisfy a pending indictment.  The incident occurred on February 1, 2018, in the City of Salamanca, when the defendant stole property and the value of the property exceeded $3,000.00 and further the defendant was driving on a public highway in an intoxicated condition. Sentencing is scheduled for January 7, 2019.

MICHAEL PARRY, 32, of Little Valley, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on March 20, 2018, in the Town of Little Valley, when the defendant operated a motor vehicle in an intoxicated condition and failed to submit to a breath test.  Sentencing is scheduled for January 7, 2019.

THOMAS  S. GEORGE, 34, of Salamanca, New York, entered a plea of guilty to Driving While Intoxicate, a class E felony; Aggravated Unlicensed Operation in the Second Degree, a misdemeanor.  The incident occurred on January 17, 1984, in the City of Salamanca, when the defendant operated a motor vehicle in an intoxicated condition while knowing that his license was suspended or revoked as a result of a previous alcohol related incident, moved his vehicle from a lane unsafely,  failing to signal and operating a motor vehicle which was not properly registered.  Sentencing is scheduled for December 3, 2018.

NICHOLE M. HEBDON, 26, of Salamanca, New York, entered a plea of guilty to  Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, class E felony to satisfy a pending indictment.  The incident occurred on or about November 24, 2017, in the City of Olean, when the defendant acted jointly  and in concert with another, each aiding and abetting the other possessed at the same time and location, with the intent to use, or knowing that another intends to use each such product to unlawfully manufacture methamphetamine. Sentencing is scheduled for January 7, 2019.

SENTENCING

ADAM PECHERZEWSKI, 23, of Hinsdale, New York, was sentenced to a one year conditional discharge; 240 hours of community service; ignition interlock for 1 year; a fine of $500.00  for his conviction to Driving While Intoxicated, a misdemeanor The incident occurred on or about January 22, 2017, in the Town of Hinsdale, when the defendant operated a motor vehicle on a public highway in an intoxicated condition.

BRYCE DEWITT, 30, of Allegany, New York, was sentenced to a term of five [5] years probation and restitution for his conviction to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony. The incident occurred on November 17, 2016, in the Town of Franklinville, when the defendant knowingly and unlawfully sold a controlled substance. 

STEPHANIE GOULD, 34, of Ashville, New York, was sentenced to  a term of one [1] year in the Cattaraugus County Jail for his conviction to Burglary in the Third Degree, a class D felony and  1 year concurrent for her conviction to Petit Larceny.  The incident occurred on February 14, 2018, in the Town of South Valley, when the defendant knowingly entered unlawfully in a building and stole property. 

JEFFREY L. FIRST, 60, of Allegany, New York,  was sentenced to a term of ten [10] year probation for his conviction to Promoting Sexual Performance by a Child, a class D felony.  The incident occurred on or about October 10, 2016, when the defendant produced, directed or promoted any performance which includes sexual conduct by a child less than seventeen years of age. 

CHARLES HOUSER, 43, of Jamestown, New York, was sentenced to a one [1] year term in the Cattaraugus County Jail for his conviction to Aggravated Family Offense, a class E felony.  The incident occurred on April 20, 2018, in the City of Salamanca, when the defendant intentionally disobeyed or resisted to the lawful process or other mandate of a court against a person who was a member of the same family or household as the defendant.

RICHARD I. FANCHER, 24, of Franklinville, New York, but presently incarcerated in the Cattaraugus Count Jail,  was sentenced to a term of 3 years  plus 2 years post release supervision with the New York State Department of Corrections for his conviction to Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony.  The incident occurred on March 29, 2018, in the Town of Freedom, when the defendant possessed and intended to use such product to unlawfully manufacture, prepare or produce methamphetamine.
