Cattaraugus County District Attorney report - July 16, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County court on Monday, July 16, 2018:

Arraignments

AKIELE MARTIN, 23, of Olean, New York, but presently incarcerated in the Erie County Jail, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony.  The incident occurred on March 8, 2018, in the City of Olean, when he allegedly unlawfully possessed a narcotic drug with the intent to sell it.  The matter has been adjourned for motions.

STACEY SPENCER, JR, 29, of Olean, New York, but presently incarcerated in the Fishkill correctional facility, entered a plea of not guilty to an indictment that charges him with two counts of Robbery in the Second Degree, class C felonies; Petit Larceny, a class A misdemeanor; Menacing in the Second Degree, a class A misdemeanor and Menacing in the First Degree, a class E felony.  The incident occurred in the City of Olean, when he allegedly forcibly stole property by displaying a firearm; intentionally placed another person in reasonable fear of physical injury or death by displaying a deadly weapon and had previously been convicted within the last ten years of menacing a police officer.  The matter has been adjourned for motions. He is currently serving a 1-3 years prison term for attempted robbery.

Guilty Pleas

AMBER PIERCE, 34, of Freedom, New York, entered a plea of guilty to Attempted Unlawful Manufacture of Methamphetamine in the Third Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on April 3, 2018, in the Town of Freedom, when she attempted to possess products to unlawfully manufacture methamphetamine.  Sentencing is scheduled for September 16, 2019, pending successful completion of drug treatment court.

HEATHER R. PILON, 24, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony and Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on March 19, 2018, in the Town of Ellicottville, when she unlawfully possessed one or more substances containing a narcotic drug and knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.  Sentencing is scheduled for September 16, 2019 pending successful completion of drug treatment court.

JOHN R. FELLOWS, 60, of East Randolph, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on February 28, 2018, in the Town of Randolph, when he operated a motor vehicle on a public highway with a BAC .22%.  Sentencing is scheduled for September 17, 2018.

Sentence

BETHANY JOHNSON, 44, of Salamanca, New York, was sentenced to three years of probation and her driver’s license revoked for one year, for her conviction to Driving While Intoxicated, a misdemeanor.  The incident occurred on July 28, 2016, in the City of Salamanca.

RICHARD SMITH, 37, of Salamanca, New York, was sentenced to five years with the New York State Department of Corrections and 10 years of Post Release Supervision for his conviction to Sexual Abuse in the First Degree, a class D felony.  The incident occurred between August 2017 and September 2017, in the City of Salamanca, when he subjected another person to sexual contact when the other person was incapable of consent by reason of being physically helpless.

GABRIEL YOUNG, 35, of Bradford, Pennsylvania, was sentenced to five years probation for his conviction to Driving While Intoxicated, a class E felony and three years concurrent probation for his conviction to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred in the City of Salamanca when the defendant operated a motor vehicle on a public highway with a BAC .13 % and knowingly and unlawfully possessed a controlled substance. 

RYAN WORTHINGTON, 35, of Olean, New York, was sentenced to five years concurrent probation for each of his convictions to Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation in the First Degree, a class E felony.  Mr. Worthington will also have his driver’s license revoked for one year as well as having Interlock Ignition Device installed in his vehicle for one year.  The incident occurred on April 7, 2018, in the City of Olean, when the defendant operated a motor vehicle on a public highway in an intoxicated condition. 

ROBERT W. DIBBLE, 29, of Olean, New York, was sentenced to one year of local incarceration with time served for his conviction to Failure to Register-Change of Address, a class E felony. The incident occurred on July 10, 2017, in the City of Olean, when the defendant, a registered sex offender and knowing the requirements thereof, failed to register with the Division of Criminal Justice Services within ten (10) calendar days after a change of address.

YVETET VALENTIN, 37, Olean, New York, was sentenced to 1 ½ years with the New York State Department of Corrections and  2 years of Post Release Supervision for her conviction to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on June 3, 2017, in the City of Olean. 

JOE R. OROZCO, 52, of Portville, New York, was sentenced to 5 year of probation, his driver’s license revoked for one year and 240 hours of community service for his conviction to Driving While Intoxicated, a class E felony.  The incident occurred on October 9, 2016 in the Town of Portville when the defendant operated a motor vehicle in an intoxicated condition.
