Cattaraugus County District Attorney Report for April 17, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 17, 2017:

Arraignment
OBIDAH T. RAMADHAN, 31, of Little Valley, New York, but presently incarcerated in the Cattaraugus County Jail, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class D felony; Tampering with Physical Evidence, a class E felony; Resisting Arrest, a class A misdemeanor; Obstruction of Governmental Administration in the Second Degree, a class A misdemeanor and Unlawful Possession of Marijuana, a violation.  The incident occurred on February 26, 2017, in the City of Olean, when the defendant allegedly possessed a narcotic drug with intent to  sell it, intended to prevent certain physical evidence about to be produced or used in an official proceeding;  intentionally prevented or attempted to prevent a police officer from effecting an authorized arrest of himself or another person, intentionally obstructed, impaired or prevented or attempted to prevent a public servant from performing an official function and knowingly and unlawfully possessed marijuana.  The matter has been adjourned for motions.

Guilty Pleas
DONALD G. HOWE, 31, of Delevan, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Failure to Register, a class E felony and Forgery in the Third Degree, a class A misdemeanor.  The incident occurred on April 5, 2017, in the Town of Yorkshire, when the defendant, being a registered sex offender, failed to register with the Division of Criminal Justice Services within 10 days after a change of address and intended to defraud, deceive or injure another, falsely made, completed or altered a written statement.  Sentencing is scheduled for July 17, 2017.

TINA M. HILL, a/k/a, TINA GANSCHOW, a/k/a, TINA TWOGUNS, 55, of Gowanda , New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fourth Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on December 21, 2015, in the Town of Persia, when the defendant knowingly and unlawfully possessed a controlled substance.  Sentencing is scheduled for July 17, 2017.

JESSICA E. LEARN a/k/a JESSICA E. LEBLANC, 25, of Allegany, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony.  The incident occurred on June 23, 2016, in the Town of Carrollton, when the defendant knowingly and unlawfully attempted to sell a controlled substance.  Sentencing is scheduled for July 17, 2017.

DLYN G. TINGUE, 44, of Machias, New York, entered a plea of guilty to  Attempted Unlawful Manuafacture of Methamphetamine in the Third Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on January 23, 2017, in the Town of Franklinville, when the defendant attempted to manufacture methamphetamine.  Sentencing is scheduled for July 17, 2017.

JOHNATHAN E. SCHUNK, 26, of Franklinville, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Burglary in the Third Degree, a class D felony.  The incident occurred on February 13, 2017, in the Town of Machias, when the defendant knowingly entered unlawfully in a building with intent to commit a crime therein.  Sentencing is scheduled for June 11, 2018.

JOE R. OROZCO, 51, of Portville, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony, to satisfy a pending indictment.  The incident occurred on October 9, 2016, in the Town of Portville, when the defendant operated a motor vehicle in an intoxicated condition.  Sentencing is scheduled for July 17, 2017.

MELISSA NESTELL, 33, of Salamanca, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony and Obstructing Governmental Administration, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on October 1, 2016, in the City of Salamanca, when the defendant operated a motor vehicle while she was in an intoxicated condition, having a .18% BAC and  prevented or attempted to prevent a public servant from performing an official function.  FURTHERMORE, MELISSA NESTELL, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony.  The incident occurred on or about November 9, 2016, in the City of Salamanca, when the defendant operated a motor vehicle while she was in an intoxicated condition.  Sentencing for both is scheduled for July 17, 2017.
