Cattaraugus County District Attorney Report - April 10, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, April 10, 2017:
Arraignments
LARRY HICKS, 37, of Olean, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony, and two (2) counts of Criminal Possession of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on January 27, 2017, in the City of Olean, when Hicks allegedly possessed a narcotic drug with the intent to sell it.  The matter has been adjourned for motions.

PAUL S. JOHNSON, 35, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony, Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony, and Criminal Use of Drug Paraphernalia in the Second Degree, a class A misdemeanor.  The incident occurred on November 18, 2016, in the City of Salamanca, when Johnson allegedly possessed a narcotic drug with the intent to sell it.  The matter has been adjourned for motions.

MAURIENNE JIMERSON, 37, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Aggravated Unlicensed Operation in the First Degree, a class E felony; Driving While Intoxicated, a class E felony; Aggravated Driving While Intoxicated, a class E felony; Use of Motor Vehicle without Interlock, a class A misdemeanor; Failure to Keep Right, a violation; and Drinking Alcohol in a Motor Vehicle, a violation.  The incident occurred on December 11, 2016, in the City of Salamanca, when she allegedly operated a motor vehicle on a public highway with a BAC of .36, and while she had reason to believe that her driver’s license was suspended or revoked.  The matter has been adjourned for motions.

JOCELYN K. COOK, 23, of Salamanca, New York, was arraigned and entered a plea of not guilty to an indictment that charges her with Driving While Intoxicated, a class E felony; Aggravated Driving While Intoxicated, a class E felony; Improper Left Turn, Failure to Signal and Use of Electronic Device, all violations.  The incident occurred on December 24, 2016, in the City of Salamanca, when she allegedly operated a motor vehicle on a public highway with a BAC of .11.  The matter has been adjourned for motions.
Guilty Pleas
JOHN ACKERMAN, 52, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Strangulation in the Second Degree, a class D felony.  The incident occurred on December 8, 2016, in the City of Olean, when he, attempted to apply pressure on the throat or neck of such person causing stupor or loss of consciousness for a period of time.  Sentencing is scheduled for June 26, 2017.

THOMAS P. KISSINGER, 21, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Arson in the Fifth Degree, a misdemeanor, and Criminal Mischief in the Fourth Degree, a class A misdemeanor.  The incident occurred on March 2, 2017, in the City of Olean, when the defendant intentionally damaged property of another without consent of the owner by intentionally starting a fire or causing an explosion.  Sentencing is scheduled for June 26, 2017.

CHELSEA LYONS, 27, of Olean, New York,  entered a plea of guilty to Criminally Negligent Homicide, an E felony; Criminal Sale of a Controlled Substance in the Third Degree, class B felony, and Criminal Sale of a Controlled Substance in the Seventh Degree, a misdemeanor, to satisfy three pending indictments.  The incidents occurred between August 13, 2015 and February 25, 2016 , in the City of Olean, when the defendant knowingly and unlawfully sold a narcotic drug, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, causing the death of another person.  Sentencing is scheduled for June 26, 2017.

THOMAS R. STANCZYKOWSKI, 33, of Olean, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Third Degree, a class B felony to satisfy a pending indictment. The incident occurred during April of 2016, in the City of Olean, when the defendant knowingly and unlawfully possessed and sold a narcotic drug. Sentencing is scheduled for June 4, 2018, after successful completion of Drug Treatment Court.

ZACHARY WALTERS, 25, of Randolph, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on September 2, 2016, in the Town of Coldspring, when the defendant operated a motor vehicle with a BAC of .12.  Sentencing is scheduled for June 26, 2017.
Sentences
ANTHONY S. LASKEY, JR., 60, of Yorkshire, New York, was sentenced to 5 years probation plus restitution for his conviction to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony, and 3 years probation for Unlawful Growing of Cannabis, a class A misdemeanor.  The incident occurred during April of 2016, in the Town of Yorkshire, when the defendant knowingly and unlawfully sold a narcotic drug, and unlawfully grew marijuana.

DARRYL HARPER, 48, of Friendship, New York, was sentenced to 5 years probation for his conviction to Attempted Burglary in the Third Degree, a class E felony.  The incident occurred on December 4, 2016, in the City of Olean, when the defendant knowingly and unlawfully attempted to enter a building with intent to commit a crime therein. 

RACHEL C. DUHAN, 25, of Olean, New York, was sentenced to 5 years probation and restitution for her conviction to Attempted Assault in the Second Degree, a class E felony. The incident occurred on July 26, 2015, in the Town of Hinsdale when the defendant knowingly attempted to cause serious physical injury to another person.  FURTHERMORE, RACHEL C. DUHAN, was sentenced to 5 years probation and restitution for her conviction to Criminal Sale of a Controlled Substance in the Fifth Degree, a class D felony.  The incident occurred on April 8, 2015, in the City of Olean, when the defendant knowingly and unlawfully sold a controlled substance. 

GARY O. THOMAS, 29, of Salamanca, New York, was sentenced to a 1 year conditional discharge for his conviction to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on February 27, 2016, in the City of Salamanca, when the defendant knowingly and unlawfully possessed a narcotic drug.

MADELEINE L. FERIA, 23, of Kill Buck, New York, was sentenced to two concurrent 60 day local jail terms for her conviction of Attempted Criminal Mischief in the Fourth Degree, a B misdemeanor, and Disorderly Conduct, a violation.  The incidents occurred on October 8, 2016, in the City of Olean, when the defendant attempted to damage the property of another person and recklessly created a risk of public inconvenience, annoyance or alarm by creating a hazardous or physically offensive condition by any act which served no legitimate purpose.
