October 5, 2018: While at the Attica School homecoming game,
Deputies located Brandon Perry, 19, of Sheldon inside his truck. Deputies claim
a strong odor of marijuana was coming from the vehicle. Once questioned, Perry
allegedly produced the marijuana and paraphernalia. Perry showed signs of
impairment and was requested to perform field sobriety tests. Perry failed the
test and was subsequently arrested for Driving while ability impaired by drugs.
Perry was taken to a drug recognition expert who determined Perry was impaired
by marijuana. Perry was charged with DWAI-Drugs and Unlawful Possession of
Marijuana. Perry is to answer his charges at the Attica Town Court at a later
date.
October 5, 2018: Two arrests were made following a traffic
stop in the Village of Wyoming. A large
white Chevrolet Express van was stopped in a business parking lot on North
Academy Street at Gulf Road for traffic infractions which had occurred on East
Bethany Road in the Town of Middlebury.
The van had allegedly been observed repeatedly swerving in and out of
its lane. The driver was identified as
Joseph S. Corcimiglia, Jr., 57, of Warsaw and he was found to have ten active
suspensions on his NYS driver’s license.
The registered owner of the vehicle, David A. Kaczmarek, Jr., 43, of
Warsaw who was riding in the passenger seat, was determined to have allowed
Corcimiglia to drive his vehicle when he knew Corcimiglia had a suspended
driver’s license. Corcimiglia and
Kaczmarek were further alleged to have both been drinking open alcoholic
beverages while traveling on the roadway.
Corcimiglia failed roadside field sobriety testing and was taken into
custody. The van truck was towed from
the scene. David A. Kaczmarek, Jr. was arrested and charged with Facilitating
Aggravated Unlicensed Operation in the Second Degree, a misdemeanor, and
Consumption of Alcohol in a Motor Vehicle.
Kaczmarek was released and scheduled to answer the charges in the Town
of Middlebury Court at a later date. Joseph S. Corcimiglia, Jr. was charged
with Aggravated Unlicensed Operation in the First Degree (Class E Felony), Driving
While Ability Impaired by Drugs, Driving While Ability Impaired by the Combined
Influence of Drugs, Aggravated Unlicensed Operation in the Second Degree,
Aggravated Unlicensed Operation in the Third Degree (Misdemeanors), Consumption
of Alcohol in a Motor Vehicle, Failed To Notify DMV of Address Change, Moved
From Lane Unsafely and Failed To Keep Right (Infractions). Corcimiglia was
arraigned in the Town of Middlebury Court where bail was set in the amount of
500.00 cash bail or $2,500.00 bond.
Corcimiglia was scheduled for further court proceedings in the Town of
Middlebury Court on October 22, 2018.
