Cattaraugus County District Attorney Report- October 9, 2018

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Tuesday, October 9, 2018:

Arraignments

MAKAYLA MIX, 23, of Killbuck, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges her with Attempted Murder in the Second Degree, a class A-II felony; 2 counts of Assault in the First Degree, B felonies; Assault in the Second Degree, a class D felony; Assault in the Third Degree, a class A misdemeanor and Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on August 3, 2018, in the Town of Great Valley, when the defendant allegedly  intended to cause the death of another person; intended to cause serious physical injury to another person by means of a deadly weapon or dangerous instrument; intended to disfigure another person seriously or permanently; being eighteen years old or more, caused physical injury to a person less than seven years old and knowingly acted in a manner likely to be injurious to the physical, mental and moral welfare of a child less than seventeen years old.  The matter has been adjourned for motions.

LOGAN SHEARER, 23, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with 2 counts of Criminal Possession of a Controlled Substance in the Third Degree, class B felonies and 2 counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies.  The incidents occurred between April 20, 2018 and April 24, 2018, in the City of Olean.  The matter has been adjourned for motions.        

LAURA HALL, 35, of Olean, New York, entered a plea of not guilty to an indictment that charges her with2 counts of Criminal Possession of a Controlled Substance in the Third Degree, class B felonies and 2 counts of Criminal Sale of a Controlled Substance in the Third Degree, class B felonies.  The incidents occurred between June 19, 2018 and June 21, 2018, in the City of Olean. The matter has been adjourned for motions.

LOUANN MAULL, 57, of Olean, New York, entered a plea of not guilty to an indictment that charges her with2 counts of Criminal Possession of a Controlled Substance in the Fourth Degree, class C felonies and 2 counts of Criminal Sale of a Controlled Substance in the Fifth Degree, class D felonies.  The incidents occurred between July 12, 2018 and July 14, 2018, in the City of Olean.  The matter has been adjourned for motions.

JACOB HANIGAN, 25, of Olean, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on March 7, 2018, in the City of Olean, when the defendant allegedly knowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

DAVIN MAULL, 20, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on July 27, 2018, in the City of Olean, when the defendant allegedly knowingly and unlawfully possessed and sold a narcotic drug.  The matter has been adjourned for motions.

DESMOND MCCULLOUGH, 30, of Rochester, New York, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Use of Drug Paraphernalia in the Second Degree, a class A misdemeanor.  The incident occurred on May 17, 2018, in the City of Olean, when the defendant allegedly knowingly and unlawfully possessed a narcotic drug with the intent to sell it and knowingly possessed or sold scales or balances used for the purpose of weighing or measuring controlled substances with the intent to unlawfully package or dispense narcotic drugs.  The matter had been adjourned for motions.

RAYMOND G. SHAFFER, 41, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony and Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony.  The incident occurred on August 21, 2018, in the City of Olean. The matter has been adjourned for motions.

ROBERT J. MCCLAIN, 45, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with Unlawful Manufacture of Methamphetamine in the Third Degree, a class D felony and Criminal Possession of a Controlled Substance in the Fourth Degree, a class C felony.  The incident occurred on August 21, 2018, in the City of Olean, when the defendant allegedly possessed at the same time and location, with the intent to use, or knowing that another intends to use each such product to unlawfully manufacture, prepare or produce methamphetamine with two or more items of laboratory equipment and two or more precursors, chemical reagents or solvents in any combination.  The matter has been adjourned for motions.

MICHELE KING, 31, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges her with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on July 28, 2018. The matter has been adjourned for motions.

JOHN HOLLAND, 55, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on June 12, 2018, in the City of Olean. The matter has been adjourned for motions.

SAMMY MCDANIEL, 41, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail, entered a plea of not guilty to an indictment that charges him with Burglary in the Second Degree, a class C felony; Harassment in the Second Degree, a violation and 2 counts of Criminal Mischief in the Fourth Degree, class A misdemeanors. The incident occurred on August 18, 2018, in the Town of Allegany, when the defendant allegedly knowingly entered unlawfully into a dwelling with intent to commit a crime therein; struck, shoved, kicked or otherwise subjected such person to physical contact or attempted or threatened to do the same; intentionally damaged the property of another person and intentionally prevented a person from requesting emergency assistance.  The matter has been adjourned for motions.

Guilty Pleas

MELISSA GOULD, 40, of Gowanda, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Petit Larceny, a class A misdemeanor.  The incident occurred on May 3, 2018, in the Town of Persia, when the defendant stole property.  Sentencing is scheduled for January 7, 2019.

AYBEK A. KORACHAYEV A/K/A IVAN KORACHAYEV, 24, of Buffalo, New York, entered a plea of guilty to Criminal Sale of Criminal Substance in the Third Degree, a class B felony, to satisfy a pending indictment.  The incident occurred on June 1, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully sold a narcotic drug.  FURTHERMORE, AYBEK A. KORACHAYEV A/K/A IVAN KORACHAYEV, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony, to satisfy a pending indictment.  The incident occurred on or about September 27, 2017, in the City of Salamanca, when the defendant knowingly and unlawfully sold a narcotic drug.  Sentencing is scheduled for January 7, 2019.

CHRISTOPHER MCCULLOUGH, 24, of Allegany, New York, entered a plea of guilty to Criminal Contempt in the First Degree, a class E felony, to satisfy a pending indictment.  The incident occurred on November 27, 2017, in the Village of Portville, when the defendant violated a duly served Allegany Town Court order of protection and intentionally placed fear of physical injury, serious physical injury or death by repeatedly following such person or engaging in a course of conduct.  Sentencing is scheduled for December 10, 2018.

YANCEY A. DOWDY, 31, of Salamanca, New York, but presently incarcerated in the Cattaraugus County Jail, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Family Offense, a class E felony.  The incident occurred on September 1, 2018, in the City of Salamanca, when the defendant against a person who was a member of the same family or household as the defendant.  Sentencing is scheduled January 14, 2019.

SENTENCING
JAMES LONG, 67, of Olean, New York was sentenced to 2 years of probation for his conviction to Criminal Possession of a Weapon in the Fourth Degree, a class A misdemeanor.  The incident occurred on April 3, 2018, in the Town of Humphrey, when the defendant possessed a firearm.

PATRICK POTTER, 25, of Delevan, New York, was sentenced to 10 years with the New York State Department of Corrections and 25 years of Post Release Supervision for his conviction to Rape in the First Degree, a class E felony.  The incident occurred on January 18, 2018, in the City of Olean, when the defendant engaged in sexual intercourse with another person by forcible compulsion.
VICTOR SMITH, 31, of Olean, New York, was sentenced to 5 years probation for his conviction to Sex Offender/Failure to Change Address, a class E felony.  The incident occurred on or about January 25, 2018, in the City of Olean, when the defendant failed to provide a change of address.
GAGE C. WEYROUGH, 20, of Cattaraugus, New York, was sentenced to 1-4 years with the New York State Department of Corrections for his conviction to Arson in the Fourth Degree, a class E felony and time served for his conviction to Criminal Trespass in the Third Degree, a class A misdemeanor.  The incident occurred on or about June 24, 2018, in the Town of New Albion, when the defendant recklessly damaged a building by intentionally starting a fire and knowingly entered and remained unlawfully in a building.
