WELLSVILLE – Four of the eight defendants accused of murdering a Wellsville man in his Main Street apartment and then dumping his lifeless body in the Genesee River have waived grand jury indictment and have accepted prosecution by Superior Court Information (SCI). Those arraigned on SCI include Jacob T. Brown, Lawrence C. Haxton III, Kristopher E. DeLill and Richelle L. Kyser. Here are the charges in each Superior Court Information:
1. Kyser: Murder, Manslaughter, gang assault and tampering with physical evidence.
2. DeLill: Murder, Manslaughter, felony assault
3. Haxton: Murder, manslaughter, felony assault
4. Brown: Murder, manslaughter, felony assault, misdemeanor assault
Already indicted by a grand jury on murder and other charges are Dylan L. Coomer, Brandon J. Poehmel, Howard M. Burroughs and Justin L. Darden.
Assistant District Attorney Michael Finn is prosecuting all eight. He was hesitant to make any comment on the case, but would admit to the intensity of the crime on the local community.
The case involves the gruesome death of Nicholas Burdge, who was killed in March inside his apartment at 172 ½ North Main Street in Wellsville. Police said he was savagely beaten for hours, killed and then his body was shoved in a garbage bag and later dumped in the Genesee River.
According to those familiar with the case, the other four who were indicted now face trial while those who accepted Superior Court Information could deal. Those with knowledge of the case said there will not be any trials set for this year, pushing everything to 2021.
Insiders expect one of more of the remaining four defendants to seek a trial. No pleas have been offered to the court yet.
