Cattaraugus County District Attorney report - March 9, 2020

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, March 9, 2020:

Arraignments

GRANTHOM TAYLOR, 37, of Olean, New York, entered a plea of not guilty to Unlawful Possession of Marijuana in the Second Degree, a violation and Criminal Possession of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on September 28, 2019, in the City of Olean, when the defendant allegedly possessed marijuana and possessed a narcotic drug with intent to sell it.  The matter has been adjourned for motions.

PATTI R. MITCHELL-BROOKS, 46, of Olean, New York, entered a plea of not guilty to Unlawful Possession of Marijuana in the Second Degree, a violation and Criminal Possession of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on September 28, 2019 in the City of Olean. The matter has been adjourned for motions.

PHILLIP GOODWILL, 36, of Humphrey, New York, entered a plea of not guilty to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony; Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor; Criminal Use of Drug Paraphernalia, a class A misdemeanor and Aggravated Unlicensed Operation in the Third Degree, an unclassified misdemeanor.  The incident occurred on October 16, 2019, in the City of Salamanca, when he allegedly knowingly and unlawfully possessed a controlled substance with the intent to sell it; knowingly and unlawfully possessed scales for the purpose of weighing or measuring controlled substances and operated a motor vehicle knowing that his privilege to operate a motor vehicle in this state was suspended, revoked or otherwise withdrawn.  The matter had been adjourned for motions.

LAVERN CORNELL, 46, of Pioneer, New York, entered a plea of not guilty to Rape in the Second Degree, a class D felony; Sexual Abuse in the First Degree, a class D felony; Endangering the Welfare of an Incompetent or Physically Disabled Person in the First Degree, a class E felony and Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred between 2015 and 2019, in the Town of Yorkshire, when the defendant allegedly engaged in sexual intercourse with another person who was incapable of consent by reason of being mentally disabled, mentally incapacitated or physically helpless and endangered the physical, mental or moral welfare of a child who was less than seventeen years old who is unable to care for herself.  The matter has been adjourned for motions.

Guilty Pleas

GORDON BROWN, 48, of Salamanca, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Endangering the Welfare of a Child, a class A misdemeanor.  The incident occurred on August 4, 2019, in the City of Salamanca, when the defendant knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.  FURTHERMORE, GORDON BROWN, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Criminal Mischief in the Third Degree, a class E felony.  The incident occurred on August 4, 2019, in the City of Salamanca, when the defendant intended to damage property of another person exceeding two hundred fifty dollars. Sentencing is scheduled for May 11, 2020.

DYLAN M. WIER, 32, of Buffalo, New York, entered a plea of guilty to Criminal Possession of a Controlled Substance in the Fifth Degree, a class D felony, to satisfy a pending indictment.  The incident occurred on May 23, 2018, in the City of Salamanca, when the knowingly and unlawfully possessed a controlled substance with the intent to sell it.  Sentencing is scheduled for June 8, 2020.

AARON OLSON, 31, of Salamanca, New York, entered a plea of guilty to Assault in the Third Degree, a class D felony and Driving While Intoxicated, a class A misdemeanor, to satisfy a pending indictment.  The incident occurred on September 6, 2019, in the City of Salamanca, when the defendant operated a motor vehicle on a public highway in an intoxicated condition and recklessly caused physical injury to another person.  Sentencing is scheduled for May 11, 2020.

Sentences

JEREMY D. BAXTER, 44, of Allegany, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class A misdemeanor and Refusal of Screening Test, a violation.  The incident occurred on August 3, 2019, in the Village of Allegany, when the defendant operated a motor vehicle in an intoxicated condition and refused to submit a breath test.  Mr. Baxter was sentenced to a 1-year Conditional Discharge, Ignition Interlock Device installed in his vehicle for 1 year and his Driver’s License was revoked for 6 months.

DAWN M. SHELLEY, 51, of Olean, New York, was sentenced to a 1-year Conditional Discharge for her conviction to Criminal Contempt in the Second Degree, a class A misdemeanor. The incident occurred on August 8, 2019, in the City of Olean, when the defendant was in violation of a duly served court order of protection.

RICHARD MORRIS, 52, of Milton, Ontario, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Aggravated Unlicensed Operation in the Third Degree, an unclassified misdemeanor and Passing a School Bus, a violation and was sentenced to a 1-year Conditional Discharge.  The incident occurred on August 31, 2019, in the Town of Ellicottville, when the defendant operated a motor vehicle knowing that his privilege to operate a motor vehicle in this state was suspended and failed to stop his vehicle before reaching a stopped school bus.

JOCELYN K. COOK, 26, of Salamanca, New York, was sentenced to 3 years of Probation and her driver’s license was revoked for 6 months for her conviction to Driving While Intoxicated, a class A misdemeanor.  The incident occurred on December 24, 2016, in the City of Salamanca, when the defendant operated a motor vehicle in an intoxicated condition on a public highway.

CORIE ROYCE, 38, of Gowanda, New York, was sentenced to a 1-year Conditional Discharge for her conviction to Attempted Tampering With Physical Evidence, a class A misdemeanor.  The incident occurred on May 18, 2019, in the Town of Napoli, when the defendant intended to suppress evidence for an official proceeding. 

DIANA M. SHAFFER, 41, of Olean, New York, was sentenced to 3 years of probation for her conviction to Criminal Possession of a Controlled Substance in the Seventh Degree, a class A misdemeanor.  The incident occurred on January 31, 2018, in the City of Olean, when the defendant possessed products to unlawfully manufacture methamphetamine.
