Cattaraugus County District Attorney Report

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, February 25, 2019:

Arraignments

JESSE SMITH, 25, of Olean, New York, entered a plea of not guilty to an indictment that charges him with 2 counts of Driving While Intoxicated, class E felonies and Head Light Violation, a violation.  The incident occurred on October 15, 2018, in the Town of Olean, when the defendant allegedly operated a motor vehicle on a public highway in an intoxicated condition and operated that motor vehicle without having proper lighting sources.  The matter has been adjourned for motions.

Guilty Pleas

SCOTT JORDAN, 44, of Little Valley, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Petit Larceny, a class A misdemeanor and Criminal Trespass in the Third Degree, a class B misdemeanor.    The incident occurred between November 5, 2018 and November 6, 2018 in the City of Olean when the defendant knowingly and intentionally entered a food cart and stole cash.  Sentencing is scheduled for April 29, 2019.

TOBIAS PRICE,41, of Niagara Falls, New York, entered a plea of guilty to Attempted Criminal Sale of a Controlled Substance in the Third Degree, a class C felony to satisfy a pending indictment.  The incident occurred on November 14, 2017, in the City of Salamanca when the defendant knowingly an unlawfully attempted to sell a narcotic drug.  Sentencing is scheduled for April 29, 2019.

JAY D. STAFFORD, 28, of Perrysburg, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Driving While Intoxicated, a class E felony and Aggravated Unlicensed Operation in the Second Degree, a class A misdemeanor.  The incident occurred on November 16, 2018, in the Town of Perrysburg when the defendant operated a motor vehicle on a public highway while he was in an intoxicated condition, knowing that his license was revoked as a result of a prior alcohol-related conviction.  Sentencing is scheduled for April 29, 2019.

ZACH A. WILLETTS, 20, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Attempted Criminal Mischief in the Fourth Degree, a class B misdemeanor.  The incident occurred on July 27, 2018, in the City of Olean when the defendant attempted to damage property with permission by the owner of the property.  Sentencing is scheduled for April 29, 2019.

RYAN SEE, 39, of Randolph, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Grand Larceny in the Third Degree, a class D felony and 2 counts of Petit Larceny, class A misdemeanors.  The incident occurred on November 26, 2018 in the Town of Randolph when the defendant stole property whose value exceeds three-thousand dollars and stole property.  Sentencing is scheduled for April 29, 2019.

ALAYA M. CRAWFORD, 25, of Olean, New York, entered a plea of guilty to Criminal Sale of a Controlled Substance in the Fifth Degree to satisfy a pending indictment.  The incident occurred between September 6, 2017 and December 22, 2017 in the City of Olean when the defendant knowingly and unlawfully sold a controlled substance.  Sentencing is scheduled for May 4, 2020.


BETH FLEISCHMAN, 40, of Arcade, New York, entered a plea of guilty to Driving While Intoxicated with a Child, a class E felony to satisfy a pending indictment.  The incident occurred on July 14, 2018, in the Town of Hinsdale, when the defendant operated a motor vehicle with a child less than fifteen years old on a public highway when her BAC was .08.  Sentencing is scheduled for May 20, 2019.


NICHOLAS O. CASTELLANO, 30, of Gowanda, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on or about May 24, 2018, in the Town of New Albion, when the defendant operated a motor vehicle on a public highway with a BAC .10 %.  Sentencing is scheduled for April 29, 2019.

Sentencing

CHRISTOPHER E. HERRON, 37, of Limestone, New York, was sentenced to time served for his conviction to Grand Larceny in the Fourth Degree, a class E felony and Attempted Robbery in the Third Degree, a class E felony.  The incident occurred on October 25, 2018 in the City of Olean, when the defendant attempted to forcibly steal a credit or debit card. 

EDWARD WAGONER, 42, of Olean, New York, but presently incarcerated in the Cattaraugus County Jail was sentenced to a term of one year with the Cattaraugus County Jail for his conviction to Criminal Possession of a Precursors of Methamphetamine, a class E felony.  The incident occurred on June 28, 2018, in the City of Olean, when the defendant possessed a precursor and a solvent or chemical agent with intent to unlawfully manufacture methamphetamine.
