Steuben County woman charged with vehicular Assault

NORTH DANSVILLE - Sheriff Thomas J. Dougherty reports the arrest of a Steuben County resident after a motor vehicle crash investigation that occurred in June of 2019.
Sadie C. Wagner 25 years of age of Wayland NY, was charged with Vehicular Assault in the Second Degree (class E felony), Driving While Ability Impaired by Drugs as a Refusal and Failure to Yield the Right of Way.
Wagner's arrest stems from a six month investigation into a motor vehicle crash that occurred on June 6th, 2019 on Hornell Rd (Rt 36) at the intersection with the Interstate-390 Exit 4 southbound off ramp in the Town of North Dansville.
The crash was caused when Wagner failed to yield the right of way by pulling off the Exit 4 southbound off ramp and in front of a tractor trailer which was southbound on Hornell Road (Route 36). The passenger of Wagner's vehicle, a 36-year-old male, sustained a leg fracture, a cervical neck fracture, rib fractures, and a sternal fracture in the crash.
Due to the refusal by Wagner to submit to a blood draw, a search warrant was obtained for any blood samples that were secured at the hospital where she was being treated. Those samples were then sent to a forensic lab for testing which did show that Wagner was under the influence of fentanyl at the time of the crash.
Wagner was located and arrested by Sheriff’s Investigator Connor Sanford of the Criminal Investigations Division. Wagner was ultimately transported to the Livingston County Jail to be processed by Central Booking Deputies and held in pre-arraignment detention.
The District Attorney’s Office provided a bail recommendation of $3,000 cash or $6,000 bond. Wagner was later arraigned by Village of Avon Justice Temperato in the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail. The Judge released Wagner on her own recognizance.
Investigating at the scene of the crash were members of the Command Staff, Criminal Investigations Division, Patrol Division, STOP DWI Unit, Forensic Investigation Unit, Commercial Vehicle Unit, Drone Unit and Drug Recognition Expert Unit. The follow up investigation was handled by several members of the Criminal Investigations Division.
