On May 18th, Deputies were advised of a motor vehicle
traveling westbound on State Route 20A near Christ Road, in the Town of Warsaw,
driving erratically passing multiple vehicles on a double solid line and
speeding. Deputies attempted to intercept the suspect vehicle in Varysburg but
the vehicle made it through the area before Deputies could locate it. Deputies
then received another traffic complaint of a vehicle, matching the description
of the previous erratic operator complaint, traveling westbound on Buffalo Hill
and almost striking another vehicle head-on. Deputies were advised the suspect
vehicle pulled over to the shoulder of the roadway and the operator claimed he
ran out of gas. Deputies arrived on scene and identified Zachary P. Liberatore,
24 of Orchard Park, NY, as the operator of the vehicle. Liberatore was put
through standardized field sobriety testing, after showing signs of
intoxication, and was subsequently arrested for driving while intoxicated.
Liberatore was transported to the Wyoming County Sheriff’s Office where he
submitted to a Datamaster DMT breath test, which showed Liberatore had a blood
alcohol content of .08%BrAC or greater. Liberatore was charged with Driving
While Intoxicated and Driving with a .08%BrAC or greater and issued appearance
tickets. Liberatore is scheduled to appear in the Town of Sheldon Court at a
later date.
On May 31st, Deputies were patrolling northbound on State
Route 19, in the Town of Warsaw, when a gray 2009 Saturn was observed traveling
northbound with a suspended registration. A traffic enforcement stop was
initiated near Mungers Mill Road. The driver of the vehicle was identified as
Ashely K. Marshall, 28 of Batavia. After further investigation, Marshall was
arrested and issued appearance tickets for Operating a Motor Vehicle with a
Suspended Registration, Uninspected Motor Vehicle, and Operating a Motor
Vehicle with Broken Glass. Marshall was released and is scheduled to appear in
the Town of Warsaw Court at a later date.
