A Perry man is facing a felony DWI charge following a
traffic stop in the Village of Perry on July 20th. Michael R. Gambino, 64, was
stopped by Deputy Chase at 10:18 p.m. for an insufficient turn signal and
failure to keep right while turning from Leicester Street onto Covington
Street. A roadside investigation was completed where open containers of alcohol
were allegedly located inside of the vehicle and Gambino subsequently failed
field sobriety testing. While being taken into custody, deputies said Gambino
resisted arrest. Gambino was charged with insufficient turn signal, failure
to keep right, consumption of alcohol in a motor vehicle, refusal to take a
breath test, resisting arrest, and felony DWI. The DWI is a felony due to
Gambino having a prior Aggravated DWI conviction in Wyoming County Court in
2012, in which Gambino served prison time. Gambino refused a chemical test and was taken to the Village
of Perry Court for arraignment. Gambino’s driving privilege was suspended for
the refusal pending a Chemical Test Refusal Hearing. Gambino was remanded to
the Wyoming County Jail without bail due to previous felony convictions.
Gambino will return to Perry Court on August 7th at 1p.m.
The Perry Police Department along with Sergeant Bryant of
the Wyoming County Sheriff’s Office assisted at the scene. Alan Bookmiller, 25, of Genesee Falls, was arraigned in
Wyoming County Court on Wednesday July 18th, 2018 in regards to an indictment
for Strangulation 2nd. Bookmiller was
indicted following an investigation by the Wyoming County Sheriff’s Office in
regards to an incident that occurred in the Town of Wethersfield in January of
2018. Bookmiller was released on his own
recognizance and is to reappear at a later date.
