Livingston County District Attorney report - September 20, 2018

After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on September 20, 2018.

ELFIN ELLIOTT, age 34, formerly of Groveland Correctional Facility was sentenced on a conviction of Attempted Assault in the Second Degree (E Felony) to 11/2 to 3 years in state prison as a second felony offender. He was also ordered to pay a $325 penalty assessment and a $50 DNA fee.
RANDY S. GADDY, SR., age 52, of Dansville was sentenced on a conviction of Driving While Impaired by Drugs (E Felony) to 30 days in the Livingston County Jail and 5 years probation. He was also ordered to pay a $520 surcharge and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.
BENJAMIN B. GRESSINGER, age 25, of Perry was charged with 2 counts of Criminal Possession of a Weapon in the Third Degree (D Felony), Prohibited Use and Possession of a Firearm, and Failure to Stop Sign at a Stop Sign. He was arraigned with his attorney, pled not guilty, and the matter was adjourned to December 20, 2018.
JEFFREY L. HAYES, age 54, of Henrietta was sentenced on a conviction of Aggravated Unlicensed Operation of a Motor Vehicle in the Third Degree (Misdemeanor) to 3 years probation. He was also ordered to pay a $200 surcharge and a $50 DNA fee.
A YOUTHFUL OFFENDER was sentenced on a violation of probation to 1 year in the Livingston County Jail.
CHARLES F. HYDE, III., age 19, of Conesus was sentenced on a conviction of Criminal Contempt in the Second Degree to 1 year in the Livingston County Jail. He was also ordered to pay a $200 surcharge, a $50 DNA fee, and an Order of Protection was issued for the victim.
ARON E. MCCALLUM, age 30, of Springwater admitted a violation of probation and the matter was adjourned to November 15, 2018 for sentencing. She was remanded to the Livingston County Jail without bail.
AUTUMN F. PIFER, age 31, of Canaseraga, charged with Grand Larceny in the Third Degree (D Felony), Forgery in the Second Degree (D Felony), and Falsifying Business Records in the First Degree (E Felony), appeared with her attorney and the matter was adjourned to October 4, 2018.
JASON A. QUICK, age 35, of Nunda, charged with Criminal Possession Marihuana in the Third Degree (E Felony) and Inadequate Exhaust, appeared with his attorney and the matter was adjourned to November 15, 2018.
BRETT S. WEBSTER, age 26, of Pennsylvania was sentenced on a conviction of Criminal Possession of a Firearm (E Felony) to 5 years probation. He was also ordered to pay a $325 surcharge and a $50 DNA fee.
