Livingston County District Attorney Report

After presentation by Gregory J. McCaffrey, District Attorney, the following cases were handled in the Livingston County Court before the Honorable Robert B. Wiggins on September 12, 2017.

DANIELLE M. ALLEN, age 22, of Livonia, charged with Manslaughter in the Second Degree (C Felony), appeared with her attorney and the matter was adjourned for hearings.

ANTHONY P. BLAVESCIUNAS, age 47, of Rochester pled guilty to Driving While Intoxicated (E Felony) and the matter was adjourned to November 21, 2017 for sentencing.

SAMMY L. BLYTHERS, JR., age 31, of Rochester, charged with Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (E Felony) and Criminal Possession of a Controlled Substance in the Seventh Degree (Misdemeanor), appeared with his attorney and the matter was adjourned to October 3, 2017.

JOSEPH R. CUOZZO, III., age 35, of York, charged with Grand Larceny in the Fourth Degree (E Felony), appeared with his attorney and the matter was adjourned to October 3, 2017.

JANET FLORES, age 42, of Rochester was sentenced on a conviction of Attempted Criminal Possession of a Controlled Substance in the Third Degree (C Felony) to 90 days incarceration and 5 years probation. She was also ordered to pay a $325 surcharge and a $50 DNA fee.

STEVEN W. GREGORY, age 27, of Kendall pled guilty to Driving While Ability Impaired by Drugs (E Felony) and the matter was adjourned to November 21, 2017 for sentencing.

LON F. JARRELL, age 62, of Lima was sentenced on a conviction of Driving with .08 of One Percent or More of Alcohol in His Blood (E Felony) to 1 to 3 years in state prison. He was also ordered to pay a $2000 fine, a $520 surcharge, and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.

EDWARD C. LEBAR, age 53, of Dansville was sentenced on a conviction of Attempted Burglary in the Third Degree (E Felony) to 5 years probation. He was also ordered to pay restitution and a $50 DNA fee.

BALDEMAR MALDONADO, age 40, of Batavia was charged with Grand Larceny in the Fourth Degree (E Felony), Criminal Possession of Stolen Property in the Fourth Degree (E Felony), and Petit Larceny (Misdemeanor). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 3, 2017. An Order of Protection was issued for the victim.

ADAM R. PETERSON, age 36, of Livonia was charged with Criminal Contempt in the First Degree (E Felony), Endangering the Welfare of a Child (Misdemeanor), and Harassment in the Second Degree. He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 3, 2017. An Order of Protection was issued for the victim.

JORDAN S. PIERSHALSKI, age 20, of Geneseo was sentenced on a conviction of Criminal Possession of a Controlled Substance in the Fifth Degree (D Felony) to 4 months intermittent incarceration and 5 years probation. He was also ordered to pay a $325 surcharge and a $50 DNA fee.

SHAWN M. SCHLEDORN, age 40, of Dansville, charged with Driving While Ability Impaired by Drugs (D Felony), Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (E Felony), and Failure to Keep Right, appeared with his attorney and the matter was adjourned to October 3, 2017.

ERICA C. STEFANO, age 36, of Piffard, charged with Welfare Fraud in the Third Degree (D Felony), Grand Larceny in the Third Degree (D Felony), Misuse of Food Stamps (D Felony), and 2 counts of Offering a False Instrument for Filing in the First Degree (E Felony), appeared without her attorney and the matter was adjourned to September 26, 2017.

KEITH R. WAITE, age 46, of Mt. Morris was sentenced on a conviction of Assault in the Third Degree (Misdemeanor) to 1 months intermittent incarceration and 3 years probation. He was also ordered to pay restitution and a $50 DNA fee. An Order of Protection was issued for the victim.
