Livingston County District Attorney Report

After presentation by Justin M. Hill, Assistant District Attorney, the following cases were handled in the Livingston County Court before the Honorable Dennis S. Cohen on September 7, 2017.

MICHAEL K. ALMETER, age 33, of Angelica was sentenced on a conviction of Driving While Intoxicated (E Felony) to 8 months intermittent incarceration and 5 years probation to include electronic home monitoring. He was also ordered to pay a $520 surcharge and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.

SEBASTIAN R. ARMELI, age 21, of Wayland was charged with Vehicular Assault in the Second Degree and Driving While Ability Impaired by Combined Influence of Drugs and Alcohol. He was arraigned with his attorney, pled not guilty, and the matter was adjourned to November 30, 2017.

RENEE M. CROPO, age 45, of Rochester was sentenced on a conviction of Driving While Intoxicated(Misdemeanor) to 3 years probation to include electronic home monitoring and 128 hours community service. She was also ordered to pay a $1000 fine, a $345 surcharge, and a $50 DNA fee. Her license was revoked with a requirement to install an Ignition Interlock Device.

SHARON L. DAVIS, age 54, of Geneseo was charged with Driving with .18 of One Percent or More of Alcohol in Her Blood (D Felony), Driving While Intoxicated (D Felony), and Failure to Stop at a Stop Sign. She appeared without an attorney and the matter was adjourned. Bail was continued at $200,000.

IRENE M. FARRELL, age 60, of Dansville was sentenced on a conviction of Driving While Intoxicated (E Felony) to 5 years probation to include electronic home monitoring and 100 hours community service. She was also ordered to pay a $1000 fine, a $520 surcharge, and a $50 DNA fee. Her license was revoked with a requirement to install an Ignition Interlock Device.

A YOUTHFUL OFFENDER was charged with Burglary in the Third Degree (D Felony) and Petit Larceny (Misdemeanor). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to November 2, 2017.

JACOB KOMARISKY, age 33, of Spencer was sentenced on a conviction of Driving While Intoxicated (E Felony), and Crossing Hazardous Markings. He was arraigned with his attorney, pled not guilty, and the matter was adjourned to September 7, 2017. His license was suspended pending prosecution.

ZACHARY J. MARTIN, age 23, of Caledonia was charged with Criminal Sale of a Controlled Substance in the Third Degree (B Felony) and Criminal Possession of a Controlled Substance in the Third Degree (B Felony). He was arraigned without an attorney, pled not guilty, and the matter was adjourned to September 13, 2017.

ARON E. MCCALLUM, age 29, of Springwater, charged with Driving While Intoxicated (E Felony) and Failure to Keep Right, appeared with her attorney and the matter was adjourned to October 5, 2017.

NICCHIA R. MCFADDEN, age 22, of Livonia was sentenced on a conviction of Driving While Intoxicated(Misdemeanor) to 3 years probation to include electronic home monitoring. He was also ordered to pay a $345surcharge and a $50 DNA fee. His license was revoked with a requirement to install an Ignition Interlock Device.

SHAHID SMITH, age 35, formerly of Livingston Correctional Facility was charged with Promoting Prison in the First Degree and Criminal Possession of a Controlled Substance in the Seventh Degree (Misdemeanor). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to July 6, 2017.

JOSEPH M. SPRING, JR., age 42, of Dansville was charged with Failure to Register or Verify Sex Offender (E Felony). He was arraigned with his attorney, pled not guilty, and the matter was adjourned to October 12, 2017. Bail was set at $2000.

AUSTIN R. VAUGHAN, age 19, of Avon was sentenced on a conviction of Criminal Mischief in the Third Degree (E Felony) to time-served and 5 years probation. He was also ordered to pay restitution and a $50 DNA fee.

DUSTIN L. WHEELER, age 22, of Dansville was sentenced on a conviction of Criminal Sale of a Controlled Substance in the Third Degree (B Felony) to 1 year in state prison plus 1 year post-release supervision. He was also ordered to pay restitution and a $50 DNA fee.

LANCE WILLIAMS, age 37, formerly of Groveland Correctional Facility, charged with Assault in the Second Degree (D Felony), appeared with his attorney and the matter was adjourned to October 5, 2017.

AMANDA S. WILSON, age 35, of Lakeville, charged with Promoting a Sexual Performance by a Child (D Felony), Possessing an Obscene Sexual Performance by a Child (E Felony), and Endangering the Welfare of a Child (Misdemeanor), appeared with her attorney and the matter was adjourned to October 12, 2017.

VIKTOR ZDOROVTSEV, age 65, of British Columbia, charged with Aggravated Driving While Intoxicated (E Felony), Driving While Intoxicated (Misdemeanor), Failure to Maintain Lane, and Driving on Shoulder of Road, appeared with his attorney and the matter was adjourned to November 2, 2017.
