Cattaraugus County District Attorney Report - August 21, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, August 21, 2017:
Arraignment
KRISTIAN GORDON-SMITH, 31 of Olean, New York, but presently incarcerated in the Livingston County Jail, was arraigned and entered a plea of not guilty to an indictment that charges him with Failure to Register Address Change with the New York State Sex offender Registry, a class D felony.  The incident occurred on February 24, 2017 in the City of Olean.  The matter has been adjourned for motions.
DYLAN M. PURDY, 25 of Kennedy, New York, was arraigned and entered a plea of not guilty to an indictment that charges him with Criminal Possession of a Controlled Substance in the Third Degree, a class B felony; and Criminal Sale of a Controlled Substance in the Third Degree, a class B felony.  The incident occurred on March 16, 2017 in the Town of Randolph, when the defendant knowingly and unlawfully allegedly possessed a narcotic substance with the intent to sell it. The defendant also knowingly and unlawfully sold a narcotic substance. The matter has been adjourned for motions.
Guilty Pleas
NICHOLAS R. COOPER. 22 of Salamanca, New York, entered a plea of guilty to Driving While Intoxicated, a class E felony to satisfy a pending indictment.  The incident occurred on November 22, 2016, in the City of Salamanca, when the defendant operated a motor vehicle on a public roadway while he was in an intoxicated condition.  Further, NICHOLAS R. COOPER, waived prosecution by indictment and entered a plea of guilty by Superior Court information to Driving While Intoxicated, a class E felony, and Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, an unclassified misdemeanor. The incident occurred on April 4, 2017, in the City of Salamanca, when the defendant operated a motor vehicle while he was in an intoxicated condition. The defendant also operated a motor vehicle on a public highway while knowing or having reason to know that such person’s license or privilege of operating such motor vehicle in this state or privilege of obtaining a license to operate such motor vehicle issued by the commissioner is suspended, revoked, or otherwise withdrawn by the commissioner. Sentencing is scheduled for October 23, 2017.
SCOTT C. JORDAN, 42,of Little Valley, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court information to Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree, a class E felony, and Driving While Ability Impaired by Drugs. The incident occurred on or about March 1, 2017, in the Town of Allegany, when the defendant operated a motor vehicle without an interlock device at a time when he was required to have one on a public highway while he was in an intoxicated condition knowing that his license was revoked as a result of a prior alcohol-related conviction. The Defendant also operated a motor vehicle while his ability to operate such vehicle was impaired by the use of a drug. Sentencing is scheduled for October 23, 2017.
Sentences
DANNY L. DAWLEY, II,34, of Arcade, New York, was sentenced to 3 years of probation, the installation of the Ignition Interlock Device for a period of 12 months, and a license revocation for a period of 6 months for his conviction to Driving While Intoxicated, a class E felony.  The incident occurred on June 5, 2015, in the Town of Yorkshire, when the defendant operated a motor vehicle in an intoxicated condition, having a .13% BAC.

CHRISTOPHER KOCHAN, 53,of Ellicottville New York, was sentenced to 3 years of probation for his conviction of Obstructing Governmental Administration in the Second Degree, a class A misdemeanor. The incident occurred on February 27, 2016 in the Town of Ellicottville, when the defendant intentionally obstructed, impaired or perverted the administration of law or other governmental function or prevented or attempted to prevent a public servant from performing an official function.

PAUL E. TYLER, JR., 30, of Cuba, New York, but incarcerated in the Cattaraugus County Jail, was sentenced to two terms of 3 ½ to 7 years and one term of 2 to 4 years with the New York State Department of Corrections for  his conviction to Burglary in the Third Degree, a class D felony.  The incident occurred on October 26, 2016, in the City of Olean, when the defendant, knowingly attempted to enter or remain unlawfully in a dwelling with intent to commit a crime therein.
