Cattaraugus County District Attorney Report - May 22, 2017

Lori Pettit Rieman, Cattaraugus County District Attorney, reported the following activity in Cattaraugus County Court on Monday, May 22, 2017:

Arraignments
JAMIE VEREEKEN, 35, was arraigned and entered a plea of not guilty to an indictment that charges her with Aggravated Driving While Intoxicated with a Child as a Passenger, a class E felony,  two [2] counts of Driving While Intoxicated, a class A misdemeanors; Failure to Stop/ Driveway, a violation; two [2] counts of Endangering the Welfare of a Child, class A misdemeanors  The incident occurred on December 24, 2016 in the Town of Little Valley, when she allegedly operated a motor vehicle with a BAC .14%  and while a child fifteen years of age or less was a passenger in such motor vehicle and knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.  The matter has been adjourned for motions.

Guilty Pleas
DANIEL P. RYAN, 31, of Olean, New York, waived prosecution by indictment and entered a plea of guilty by Superior Court Information to Tampering with Physical Evidence, a class E felony.  The incident occurred on March 31, 2017 in the City of Olean, when the defendant believing that certain physical evidence is about to be produced or used in an official proceeding or a prospective official proceeding, and intending to prevent the use of production thereof, he suppressed it by alteration or destruction. Sentencing is scheduled for July 9, 2018 upon successful completion of Drug Treatment Court.

Sentences
JARON ANTHONY BALL, 21, of Salamanca, New York, was sentenced to Determinant Term of 2  1/3 - 7 years with the New York State Department of Corrections for his conviction to Disseminating Indecent Material to Minors in the First Degree, a class D felony and 1 year term for his conviction to Sexual Misconduct, a class A misdemeanor to run concurrent. The incident occurred on September 18, 2016, in the Town of Great Valley, when the defendant knowing the character of the content of the communication which in whole or part, depicted actual or stimulated nudity and engaged in sexual intercourse with  another person without such person’s consent.

CASEY R. GILCREASE, 25, of Delevan, New York, was sentenced to a term of 10 years probation; six [6] months incarceration for his conviction to Rape in the Third Degree, class E felony and a term of 3 years probation for his conviction to Endangering the Welfare of a Child, class A misdemeanor.  The incident occurred on November 12, 2016, in the Town of Machias, when the defendant being twenty on years old or more, engaged in sexual intercourse with another person who was less than seventeen years old and acted in a manner likely to be injurious to the physical , mental or moral welfare of a child less than seventeen years old. 

AMY L. SCHOONAMAKER, 37, of Olean, New York, was sentenced to a term of 1 to 3 years with the New York State Department of Corrections for her conviction to Attempted Assault in the Second Degree, class E felony; restitution and a term of 1 year for her Violation of Probation to run concurrent. The incident occurred on January 23, 2017, in the City of Olean, when the defendant, with intent to cause physical injury to another person, caused such injury to such person by means of a deadly weapon or dangerous instrument. 

CYRUS SPRUCE, 20, of Little Valley, New York,  was sentenced to a Indeterminate term of 5 to 15 years with the New York State Department of Corrections for his conviction to Manslaughter in the Second Degree, a class C felony.  The incident occurred between May 21, 2016 and May 22, 2016, in the Town of Red House, when the defendant recklessly caused the death of another person.
